Sub: Implementation of DOPT OM F. No. 11012/04/2016-Estt.(A) Dt. 23.08.16-request reg.   
Sir,
            With due regards, your kind attention is invited to the subject-mentioned OM of DOPT and prolonged suspension of Sh. S. Asokaraj, Superintendent.
            2. It is submitted that the charge-sheet has already been filed by the CBI in this case. Sh. Asokaraj has been alleged to demand illegal gratification from the complainant but no direct recovery was made from him. He is already under suspension for more than 18 months.
            3. Keeping in view the subject-mentioned DOPT OM F.No.11012/04/2016-Estt.(A) Dt. 23.08.16, Sh. Asokaraj should no more be placed under suspension. It is also worth to mention that the purpose of the suspension is “temporary withdrawal of duties from a government servant during the pendency of the inquiry”. The said purpose has already been fulfilled in this case on account of the charge sheet being already filed and no inquiry being pending.
            4. Such cases never fall in the category where continuance in office of the Government servant will prejudice the investigation, trial or any inquiry. There is no apprehension of tampering with witnesses or documents in such cases after filing of the charge sheet. Even if anything such is apprehended, the officers may be transferred to some other office/place from the original office/place by revoking the suspension for the purpose of utilization of the government manpower for government work in public interest.
            5. No need to submit that the government money, being paid as subsistence allowance in such cases, would be utilized for public by revocation of suspension.
            6. In view of the above, it is requested to kindly implement the said OM of the DOPT to give benefit to the suspended officers including Sh. Asokaraj.
