Minutes of Associate Committee Meeting held at C.R. Building, New
Delhi on 19.08.2017
At the outset, the Secretary
General Shri Ravi Malik welcomed all the delegates. He briefed all the
representatives about various aspects of career prospects, DPC, pay matters and
infrastructure status as well as recent developments at Board level and gist of
recent meeting held with Member (Admn). He further requested all to be brief
and to the point and also to give constrictive suggestions on the issues during
the course of discussions.
Thereafter, he requested
the President, Shri A. Venkatesh, to preside the meeting as per the agenda.
Shri Venkatesh welcomed
all participants and asked to have smooth & positive deliberations on the
agenda points. He declared the meeting open for them same.
The under mentioned points were scheduled in the agenda-
1) Measures to improve the career
prospects including DPC for the post of Asstt. Commissioner.
2) Pay matters including MACPS.
3) Working conditions including infrastructure.
4) Organisational matters including DDO
certificates, dues & funds.
5) Any other point/s with the permission of
the Chair.
Before
commencement of the discussions, the President requested Secretary General to brief
the house on agenda points. At the outset of his comments, Secretary General
emphasized that the DPC for the post of Asstt. Commissioner should be conducted
at the earliest inspite whatever is running at various fronts or segments. He
said that DPC should not be delayed under any circumstances as our officers are
retiring every month without promotion. He also informed the house that the
CBEC had filed a review petition on the issue which has been dismissed by the Madras High Court. Now, CBEC
will approach the Supreme Court as said by the Member (Admn.) during the
meeting of 18.08.17. Sh. Malik also suggested that the Association should also
approach the Supreme Court on the issue of DPC without challenging the merits
of the case of the applicants in Bharatan case on Parmar issue as was done to
get the stay on DPC vacated in Madras High Court on last occasion. He also
suggested to go to the legal court for the promotion of Superintendent to a STS
post instead of JTS post. The House agreed to his suggestions and it was
resolved to approach the Supreme Court on the issue of DPC and to respective
court on the issue of promotion to the STS post. The Secretary General further
requested delegates to collect the funds for the legal fight including this
issue as the Association is already short of funds. He also requested that
units should also clear their pending dues which have already reached the tune
of Rs. 20 lac. He declared S/Sh. C. S. Sharma, N. R. Manda and Soumen
Bhattachariya respectively to be Office Secretary, Treasurer and Organising
Secretary (as one man committee to look organisational work) of the
Association. As asked by the Secretary
General, Sh. N. R. Manda, Treasurer of the Association, gave the breakup of the
pending dues per unit.
The Secretary General
stressed that unity and solidarity on the part of fraternity is very much
required. He earnestly pleaded for mass movement at every Range to Division to
Commissionerate level across the country for display of mass strength in
peaceful manner to achieve the goals; otherwise he cautioned that there was
little hope for the redressal of cadre related issues. He added that every
member would have to learn to fight for justice showing unity. Wherever
required, we will have to show the crowd for the cause of the cadre.
Sh
Anand Kishore, Joint Secretary of AIACEGEO, also opined and favoured for early
DPC for the post of Asstt. Commissioner. However, side by side, he suggested
that we should take cue from State GST as it has been learnt that the states
are according one grade higher to their officers in GST regime. He said that we
should also build our pressure on the Board for similar upgradation and parity
in view of the fact that CGST officers are far enriched and expert than SGST
officers in view of the vast experience in handling of Service Tax and
collection of Indirect Tax.
Sh. P. Shravan Kumar,
Joint Secretary of AIACEGEO, while expressing his opinion on the matter of
conducting early DPC sought approval from the Chair and house that the Association should file a petition in the
Supreme Court in partnership with the Government for conducting early DPC.
At this point there was a commotion in the house and every representative
started airing their opinion in the matter. Sensing the sensitivity of the house
and issue involved, the Secretary General intervened to pacify the house and the
opinion as submitted by Sh P. Shravan Kumar was thrown open to the house
for the consideration & opinion. It was heartening to note that house was
united and approved the proposal to go to Supreme Court for DPC in equal voice.
Secretary General
accepted the affirmative opinion aired by house in one voice and welcomed the
sentiments of house. However, he submitted that Association should seek the
opinion from the Advocate for its feasibility & applicability. The Chair
declared the matter as approved.
Sh. C.S. Sharma,
President of Delhi Unit and Office Secretary of the AIACEGEO, in the meantime
dittoed for early conducting of DPC yet cautioned that whatever move or line of
action is adopted for meeting the cause, under no circumstances promotions etc.
should be derailed or delayed.
Sh. N. R. Manda,
Vice-President of Delhi unit and Treasures of AIACEGEO, Sh. Ravi Joshi,
Vice-President of Delhi Unit as well as AIACEGEO, Sh. N. S. Maheshwari,
Treasurer of Kutch Unit, and Sh. Dilip J. Pandya, Secretary of Rajkot Unit,
echoed for early conducting of DPC. Sh. Pandya stressed that the legal
measures/aspects should be taken care of in the matter.
Sh. B. P. K. Reddy,
General Secretary of Hyderabad and Joint Secretary of AIACEGEO, in principal
echoed the view of conducting early DPC but in the meanwhile cautioned that
whatever steps in the direction are initiated should not be in confrontation
with IRS promotee Association. He also advocated for firm & concrete
efforts to be taken in regularization of 2118 posts as a onetime measure. He
expressed his deep dismay over the developments with regard to division of
Association. He appraised the house that the misinformation and wrong messages are
being spread by the splinter group, which in his opinion, are not going to
serve the purpose but may prove damaging in the long run for one and all. Under
such circumstances, the very unity and solidarity of the Association may be at
peril. Under this scenario, he rather suggested and advocated for unified fight
by coming to a single platform by all the three groups, i.e., ( i) AIACEGEO (ii)
Splinter group and (iii) IRS promotee Officers Association, to fight the Board.
Continuing his remarks, Sh. B. P. K. Reddy, further advocated for change in the
nomenclature of the designation of the Superintendent at par with the SGST
officers, if promotion to the post of Asstt. Commissioner was not in sight in the
near future. At least, the designation of Superintendent should be upgraded at
par with SGST officers as it has been learnt that SGST officers have been upgraded
one grade higher in the GST regime. This will not only remove the anomaly
but will also confer the job satisfaction because the SGST officers are far
junior in terms of length of service as well as experience. Further, giving
another upgradation to a less experienced & junior SGST officer will surely
be a matter of disparity and discontentment among the CGST officers and will
also have a wide ranging ramification down the line vis a vis inter-se
deputation and exercising official authority.
Sh. P. Sharvan Kumar,
however, disagreed with the opinion as expressed by Sh. B. P. K. Reddy. He said
that none of the above said two groups can be termed as Association. Actual
AIACEGEO is “we people” and Sh. Manimohan & Co. is merely a splinter group.
As far as promotee IRS officers Association is concerned, the officers promoted
on ad-hoc basis can’t form separate association. So, none of the above referred
two groups can be termed as association. However, nothing is better than unity
and both of the above groups should understand this thing. He added that Sh.
Manimohan & Co. is only misusing the name of our AIACEGEO without any
authority and there can noway be two associations in the same name.
Sh. Sanjeev Sahai, Joint
Secretary of AIACEGEO as well as Mumbai Unit, echoed the view points as aired
by Sh. B. P. K. Reddy on the issue of unity. He, however, said that none of the
above two groups can be termed as association but they are nuisance creator. He
also said that some deputation scheme should be evolved to send our officers to
state governments, PSUs etc.
Since a lot of
discussions & references had taken place in the name of upgradation and
deputation, the President asked Secretary General to address the issue in the
light of the developments being taken place in the Board office. The Secretary
General said that the stagnation committee has already recommended for our
o0fficers to go to the state governments on deputation under GST but it would
have to be approved by the GST council as Board has no power to send our
officers anywhere on deputation on its own in absence of requisition from the
concerned department whether under any state government or PSU or central
government. He further added that our officers can go on deputation to any
concerned department under any government as per eligibility and service
conditions in accordance of the requisition from the concerned department.
Sh. Sanjay Kumar Mishra,
General Secretary of Patna/Ranchi/Jamshedpur Unit, Sh. Ajay Kumar, Joint
Secretary of AIACEGEO, Sh. P. C. Jha, Vice President of AIACEGEO, Sh. Apurba
Roy, Vice-President of AIACEGEO and Sh. Soumen Bhattachariya, Organising
Secretary of AIACEGEO, dittoed and affirmed for conducting of early DPC for the
post of Asstt. Commissioner.
In
the meantime, Sh. C. S. Sharma took cognizance and requested the Chair to
discuss the suggestion as mooted by Sh. B. P. K. Reddy for unified fight by all
three concerned groups before the Board. He asked for the clarification how
this unification is possible effectively. How other groups can be brought to a
single platform with us and who will assume the responsibility of mediation.
In response to the query
raised by Sh. C.S. Sharma, the Secretary General apprised the efforts made in
the past for unification as well as to work under single umbrella for
good cause of the Association and cadre so as to avoid any weakening signals and
to display strength and unity before the Board as well as all concerned
departments/authorities. Despite of the efforts made in the past, nothing yielded
so far yet he strongly advocated for unity & togetherness. Secretary
General also appealed all delegates to make all out efforts, individually and
collectively, for unity and in the interest of the cadre.
Sh.
Sanjay Kumar Mishra, General Secretary of PRJ Unit, stressed that
the Association should leave apart all business to back bench and focus on
getting renewal of recognition of Association to address the issue of
unification and united fight etc. In the opinion of Sh. Sanjay Kumar Mishra,
obtaining of renewal certificate of recognition of Association could be
masterstroke in the interest of the cadre.
The Secretary General said that we have already filed relevant papers
for renewal and it is being pursued despite of the fact that there is no
provision of renewal in RSA Rules, 1993. We have already asked from CBEC about
the provisions of renewal under RTI but the Board has given no reply till date.
However, we will require DDO certificates for the purpose but the same are not
being provided by the units despite of the repeated persuasions. He again
appealed that all units may kindly provide DDO certificates for the year
2016-17 and also 2017-18 immediately.
Sh. Ashish Vajpeyi,
Vice-President of AIACEGEO and General Secretary of Kanpur Unit, batted for
conducting of early DPC as well as the continuation of temporary posts of
Asstt. Commissioner for another five years.
Sh.
Sanjeev Sahai welcomed the proposal for conducting early DPC. However in view
of the lethargic and indifferent attitude of the Board office with regard to
DPC & career prospects, he also suggested for diversification in the shape
of deputation to PSUs and SGST to get job satisfaction as well as work culture.
Sh. Sanjeev Sahai also brought to the notice of the Chair that there should not
be even a slight mis-connection in communication between the AIACEGEO and rest
of the units. In the absence of timely communication, unrest and dissipation may
be felt by the members. He cited a recent instance wherein only a couple of
days ago a meeting between Member (Admn) and staff associations happened
which was not communicated to the units. After listening it, the Secretary
General clarified that it was very well communicated to all units, perhaps Sh.
Sahai couldn’t see that message. Other delegates supported the clarification of
Secretary General.
Before
concluding his comments, Sh. Sahai further said that he wished to sponsor a few
points and suggestions on behalf of the Mumbai Unit for consideration and
adoption for the betterment and good cause of cadre. After obtaining approval
from the Chair, he read the points also submitting the copy of the letter
dated 19.08.17 having these points. The points were as under-
(i) Classification
of sensitive and non sensitive posting and guidance for posting policy in GST
as formation changed.
(ii) The
stagnation committee and high power committee report to analyze - firstly
stagnation committee report and its suggestions if any should be applicable to
only Central Excise officers as this is the stagnated cadre and others are not.
Most important is to remove stagnation by making one seniority and remove
disparity in promotions. Promotion from Examiner to Appraiser to AC to be
freezed till uniformity is attained and similarly apply new criteria for
parity, i.e., Inspectors/Examiners are same. We may make seniority common so
that juniors should not get promotion before senior in any cadre at any CCA.
Loss of pay due to disparity in promotion is also to be rectified.
(iii) Immediate
implementation of Parmar judgement across all CCAs.
(iv) Immediate
DPC for the promotion of AC.
(v) Separate
PAO or one single PAO for GPF in zone to avoid transfer of accounts within
zone.
(vi) Executive
Commissionerate Office should be located in the respective jurisdiction. If any
Commissionerate is not acting on staff welfare measures, it should be reflected
in their APAR grading to make them accountable.
(vii) If
Customs related work is given to Customs, we have to decide for total
separation as to why we should do their unwanted work and hardship postings.
(viii) Policy
in response to Court matters should be in the light of recent judgement from
Chandigarh circulated by Board and also strict compliance to complete and close
all vigilance cases where no monetary angle is involved.
(ix) Most
importantly, the fate of the splinter Association is to be decided and urgent
steps be taken for unification of the breakaway members/association for the
benefit of entire cadre and solidarity/unity.
In the last before
winding up his view points, Sh. Sanjeev Sahai emphatically stressed for unity,
unification, solidarity and display of strength to yield the desired
result.
Sh. Harpal Singh,
President of Meerut Zone and Joint Secretary of AIACEGEO, also echoed for
conducting of early DPC for the post of Asstt. Commissioner. He was also of the
opinion that the Association should fight in Supreme Court in tandem with and
in partnership of CBEC. He also raised the point of regularisation.
The
Secretary General, with regard to the regularization, apprised that regularization
has been completed upto the period of 2001-02 and is under process for further
period.
Sh. A.K. Meena,
Vice-President of AIACEGEO and General Secretary of Kutch Unit, statistically
updated the house that only 850 posts have been filled-up out of 2118 temporary
posts of AC whereas 845 posts are being shown vacant in 2017 as per the HRD
website. Sh. Meena also submitted a few representations to the Chair
brought from Gujarat regarding promotion.
In the meantime, Sh. C. S.
Sharma with the approval of the Chair appealed to all the concerned kindly be
united to make the Association strong to fight adequately & appropriately.
There are no lacking in the efforts on the part of Association and Secretary
General. The outcome and result will surely be beneficial to all. The house in
one voice applauded his view point & positive attitude and thumped the desk
with all smile.
Discussions on agenda
point No. 2, 3 & 4
In view of paucity of
time, the delegates were advised to speak and submit their opinion in one go on
all the remaining agenda points so as to complete the proceedings in time for
convenience of all.
The following were agenda points-
i) Pay matters including MACPS.
ii) Working conditions including infrastructure.
iii) Organisational matters including DDO certificates,
dues & funds
S/Sh. Anand Kishore and P. Shravan Kumar
pointed out for GP of Rs. 6600 and 7600 under MACPS. This case is on final
hearing in Principal Bench of CAT. General implementation of Chandrasekaran
case is also being pursued in Principal Bench of CAT.
On the issue of MACP
benchmark raised by Hyderabad delegate, the Secretary General said that the
issue is being taken up with the Board and was also raised in the meeting of
18.08.17. He also advised to obtain copy of minutes on MACP DPC from Delhi-I through
RTI since the issue had attained the finality in Delhi zone.
Sh. N. R. Manda raised
the issue of outstanding dues pending with the units. He pointed out that approximately
Rs. 20 lac are outstanding against the various units. On such a state of
affairs and huge amount being outstanding, the Chair asked all units to be
serious. On the advice of Chair, outstanding dues were pronounced in the open
house. Sh. N. R. Manda further brought to the notice of house that even DDO
certificates are not being submitted.
Seeing the alarming
outstanding dues and non submission of DDO certificate, the Secretary General appealed
the Office Secretary, Treasurer, Organising Secretary and all India zonal
office bearers to be active and play appropriate role on the outstanding dues
and DDO certificates to pursue with concerned units on regular basis.
Sh. Dilip J. Pandya expressed
his deep anguish on infrastructure front for space crunch and pathetic condition
being faced by the staff in his Zone. He was more perturbed that administration
and seniors were just casual and have no humane approach to solve the crisis
since they are not facing inconvenience or heat of discomfort being well
settled in their well groomed air-conditioned rooms.
Sh. Dilip Pandya
expressed his shock against the inaction on the part of units for their
inability to submit DDO Certificates and clear pending dues. In view of
non-availability of DDO certificates, he also expressed his apprehension that the
Board may take adverse view and may consider to de-recognising the Association under
such circumstances. He showed his serious concern for this state of affairs suggesting
that the concerned unit/s should not be allowed to attend Association meetings,
if failed to submit or bring DDO Certificate in time bound manner.
In continuation of his
comments, Sh. Dilip Pandya further pointed out that no point or
matters pertaining to Customs are discussed in the house at AEC meeting
or at other likewise deliberations. He further highlighted that the job of Customs
is anti-smuggling activities and not anti-terrorist or security activities but
the staff are often entrusted with the job of anti-terrorist or security activities
in the name or guise of anti-smuggling activities in their zone, being a large
part covered with coastal & marine area,. To further elaborate the
issue in details, he assured that he would submit a detailed letter and
requested the Chair to take up the matter at appropriate level.
To address the issue of
infrastructure in entirety as Association had got the relevant letter written
to field formations by the CBEC even before the approval of the cadre
restructuring, the Secretary General suggested that every unit should write a
proposal letter to their respective HOD or HOO for infrastructure deficiency
and space crunch being faced by the staff and tag the same to the Association
so as to collate the same for placing before Board Office.
Sh. Shailendra Kumar,
President of Patna-Ranchi-Jamshedpur Unit, raised a query with regard to
inadequacy or anomaly in continuation of uniform in the GST regime. He
requested that position as on the date be obtained from the Board.
During the deliberations,
a query was arisen under what provision the legacy work is being carried out in
the GST regime. In this regard, Sh. B. P. K. Reddy clarified that the provisions
for legacy work have been prescribed under section of 174 of GST Act apart from
Audit and Investigation.
On the issue of non-submission
of DDO certificates and seeing the huge pendency, he cautioned the Chair in
the interest of the cadre and unity that the work of obtaining of DDO
certificates be done on emergent basis else splinter group can derive undue advantage
of situation and Board may also decline to reckon the sanctity of the Association.
With regard to the state
of affairs of infrastructure status, he submitted that there is no
improvement and situation is no better than pre-GST regime inspite of the fact
that Board is liberal on this front but the dynamism is lacking at the level of
CC and IRS officers. He added that lease rent ceiling has been enhanced from Rs.
3 lac to Rs. 10 lac which is quite liberal and positive step.
On organizational issues,
he sketched out a grim situation for staff and cadre in GST regime. He
expressed his fear & anxiety that the very existence of Superintendents/Inspectors
is at stake in view of the fact that the most of the work in the GST is online.
The refund is online. The Audit/scrutiny is minimum. Export sealing is done
away. All these factors one day may render Superintendents/Inspectors to
be jobless or useless or it may be the possible reason & cause of
retrenchment.
To tackle such a
situation, as in view of the fact that tilt is in the favour of states in
the light of provision of 90:10 and 50:50 ratio of division between states and
Centre, he suggested that a proposal be mooted to the GST Council and/or Board,
as the case may be, that job of Audit be entrusted in the ratio of 75:25
between central officers and state officers in view of vast and wide experience
of central officers. The central officers have dealt the issue of service tax for
last 23 years whereas this issue is purely new for state officers and they have
no previous exposure to it.
Sh. Ashish Vajpayee
added no new comments and stood for already said/submitted.
Sh. Sanjeev Sahai added
that we should not hang on the issue of uniform etc. and rather emphasize on
other important issues and let the uniform issue be tagged as non priority. The
issue is not such a big or important enough to spare that much energy.
Sh. A. K. Meena on the
issue of DDO certificates clarified that there is no pendency on the part of
their unit and assured that the certificates will follow well in time in
future also.
Sh. Sanjay K. Mishra once
again emphasized on organization front and emphatically repeated that the
splinter group is gaining momentum and presence is felt in the state units.
They are making inroads by way of vigorous publicity and person to person
contact by hook or crook. He further emphasized and repeated that the renewal
of recognition of association will be great boosting and win-win situation.
Efforts in this direction should be made in more sincere and focussed manner.
He further added that, to thwart the splinter group, the Association should get
hold of DDO certificates so as to make out the point that this association is
the only valid and real Association.
He raised above-referred
line of action repeatedly and vigorously and as much as that he appealed the
house that let all other issues and endeavours may be considered to put on hold.
He was of the opinion that this cause is more important for the sake of unity
and existence of the Association. He also asked for the copy of the
Constitution of Association which was provided to him.
The Secretary General reiterated
that all units should deposit the DDO certificates immediately covering the
year 2016-17 and also 2017-18. He appealed all delegates to be more
concentrate, concrete and focused with renewed efforts.
Sh. P.C. Jha raised
the MACP issue. On the ongoing issue of DDO certificates, he sought
clarification about the status of the promotee IRS officers’ DDO certificates.
In this regard, the Secretary General clarified that wherever such promotee
officer is posted, he/she will be member of that respective unit and DDO
certificate would be issued by the respective DDO.
Continuing his comments,
Sh. P. C. Jha, further added that infrastructure funds earmarked for the
purpose are not being utilized in their Commissionerate because of
basic attitude of IRS and seniors though ample funds are available .
He desired that Association should take up the matter with the Board office and
let the Board office ascertain the expenditure status of the respective
Commissionerate whether the funds are being utilized or remain unutilised and
reason thereof.
On organization front,
Sh P. C. Jha, further added and advocated that we should endeavour for unity
and unification and all out efforts should be made for strengthening the cadre
and Association.
Sh. Soumen Bhattachariya,
the Organising Secretary of AIACEGEO, intimated that about 35-40 promotee IRS officers
are members of state unit in Kolkatta region. He also requested the Chair for
taking-up of a few cases of transfer of their region with Board office on
medical ground. In this regard, the Chair advised him to send the
representations to the Member (Admn) with copy to the ADG, HRM-II and a copy
endorsed to the Association for taking-up at appropriate level.
Sh. Harpal Singh added
nothing new in his comments as he opined that all points have already been
taken and discussed. However, he assured that remaining DDO certificates would
be submitted latest by October, 2017.
On infrastructure aspect,
Sh. Meena highlighted the pathetic and shameless condition prevailing in their
Commissionerate. He requested the Chair to take-up the issue with the Board office
about poor condition of infrastructure.
He suggested that voting
right be withdrawn from the non-subscribers for Association to fall them in
line. The Chair listened attentively and expressed solidarity yet he cautioned
that issue be discussed with them in good stride because snatching of voting
right will adversely affect the cadre and weaken the Association
At the end of
deliberations, the President thanked for running the house in democratic and
amicable manner and also for constructive and valuable inputs given by the
delegates for unity, solidarity and strengthening of Association and also in
the larger interest of the cadre. He also winded up the proceedings with the
remarks that-
(1)MACP issue is being
taken up administratively as well as legally in the court.
(2) DPC- Opinion will be
obtained from the advocate for preparation and filing of petition in the
Supreme Court in partnership with the department or independently after getting
the copy of Madras High Court order in review petition of the govt. A case for
promotion of Superintendent to STS post will also be filed in the legal court.
(3)Infrastructure- State
units will first write to their respective Commissionerate for the state of
affairs in their region with a copy to the Association which in turn will
take up the matter with the Board office.
(4) DDO Certificates and
pending dues- The units should ensure that DDO Certificates and outstanding due
be cleared at the earliest.
(5) All out efforts will
be made to yield the result and outcome in the best interest of the cadre including
betterment in terms of career prospects, DPC, infrastructure etc. etc. Every
step, administrative or legal, will be taken on every issue in the interest of
the cadre.

Ravi Malik appealed the Office Secretary, Treasurer and Organising Secretary to
be in regular touch with all units for immediate submission of DDO certificates,
clearance of pending dues and donate maximum funds for the Association. Same
appeal was made by him to all Vice Presidents and Joint Secretaries
particularly for the units pertaining to the respective zone.
The meeting was
organized by Delhi Unit. Sh. C. S. Sharma, President of Delhi Unit, expressed
his deep gratitude to all participants for their gracious presence.
