Madam,
With due regards, a gentle reminder is
made to your goodself about your kind willingness to bring a scheme for Central
Excise executive officers benefitting the old as well as young generation. We are very hopeful and waiting for the same very
eagerly but the same is yet to come.
2. As far as the distribution of assessees between the
states and centre is concerned, the same has also been started without paying
any heed to the career prospects of workforce of CBEC itself alongwith Central
Govt. The redressal of other HR issues relating to the Central Excise gazetted
executive officers is also long pending. The condition relating to the
implementation of various court verdicts and decisions taken in employee
grievance redressal meetings is also the worst. The meetings under employee grievance
redressal mechanism are not being held despite of being due after every two
months. Thus, the list of the grievances of your workforce has become endless.
3. Accordingly, it is requested to have a board
meeting to listen the Association in person for due redressal of the following
points under employee grievance redressal mechanism -
(1) Scheme benefitting
the old as well as young Central Excise executive officers.
(2) Upgradation of posts/scales like
state governments under GST.
(3)
DPC for the post of Asstt. Commissioner.
(4)
Batch to batch Non Functional Financial Upgradation to our officers to grant at
least financial parity with the best placed counterparts of CSS etc.
(5)
Implementation of the court verdicts including Subramanium case regarding time
scale by Hon’ble Supreme Court and OA No. 2323/2012 regarding RRs by Principal
Bench of Hon’ble CAT.
(6)
Distribution of assesses between states and centre.
(7) Infrastructure and office space.
(8)
Implementation of the decisions taken in earlier meetings and
finalization/redressal of old points.
(9)
any other point/s.
2. Your
goodself is once more requested to look into the above issues for the sake of
justice to the Central Excise executive officers, the most of whom are retiring
with single promotion in their career after joining as Inspector.

Sub: Retention of General Pool accommodation in Delhi
for the officers transferred to NCR.
Sir,
Kindly
refer to the Ref. No. 23/AIB/A/17 Dt. 06.07.17 of the Association.
2. It is again submitted with due regards that a good
number of officers, working under CBEC, have been transferred to National
Capital Region on implementation of GST. Many of them are having General Pool
accommodation in Delhi.
3. It is further submitted that the families including
old aged parents and school/college going children of these officers are
settled in Delhi for many years. Their wards are making due studies in the
schools, colleges and institutes situated in Delhi itself. Parents and other
family members of these officers may also be under medical treatment in the
various hospitals situated in Delhi. Many of other family affairs of them may
be settled in Delhi.

But the retention of General Pool accommodation is not permitted as per the
existing guidelines of the Directorate of Estates, Ministry of Urban Development,
if an officer is transferred out of Delhi. Retention of accommodation is not
allowed, even if the officer is posted in National Capital Region. Thus, such
officers are finding it difficult to retain the govt. accommodation allotted to
them in Delhi.
5. In this regard, it is also worth to mention that the
Noida Export Processing Zone (NEPZ)/Noida Special Economic Zone (NSEZ) were
allotted a quota in Delhi by the Directorate of Estates. The officers posted at
NEPZ/NSEZ, Noida can retain such accommodation in Delhi. They are also
permitted to apply afresh, if they desire so. No need to say that Delhi has now
become an integral part of the National Capital Region. Accordingly being
assured of retaining the accommodation in Delhi, shall help these officers to
perform their duties peacefully under the GST regime.
6. In view of the above, it is requested that the
officers transferred from Delhi to NCR may kindly be allowed to retain the
accommodation at Delhi by earmarking a quota of General Pool accommodation to
the officers of CBEC.

Sub: Conversion of Home Town LTC to
NER/A&N/J&K LTC.
Sir,
Kindly refer to the
Ref. No. 91/AIB/LTC/17 Dt. 06.09.17 of the Association and DOPT OM issued vide No.
31011/ 3/ 2014-Estt.(A-IV) Dt. 19.09.16 with the subject, “Central Civil Services
(Leave Travel Concession) Rules, 1988 — Relaxation to travel by air to visit
NER, J&K and A&N”.
2. Para 2 of the above
mentioned DOPT OM states as under-
“2. The above special dispensation is subject to the
following terms & conditions:
(i) All eligible Government servants may avail LTC to
visit any place in NER/A&N/J&K against the conversion of their one Home
Town LTC in a four year block.
(ii) Government servants whose Home Town and
Headquarters/place of posting are the same are not allowed the conversion.”
3. It is submitted
with due regards that not to allow conversion of one Home Town LTC to NER/A&N/J&K
LTC is great injustice to the officers whose Home Town and Headquarters/place
of posting are the same. This is also not in the interest of the tourism.
4. It is further
submitted that these officers are already at loss in regard of Home Town LTC as
“to be posted/transferred to Home Town or not” is not in their hands. They are
transferred/posted to Home Town or any station as per the transfer/posting
policy/norms in force.
5. In view of the
above; it is requested that the matter may kindly be reviewed and the officers posted at Home Towns may also
be allowed to convert Home Town LTC into regular LTC, otherwise the
officers having Home Town in Delhi State, Chandigarh and Puducherry U.T. etc.
would never be able to get this opportunity on posting to their Home Town
despite of being resident of state/U.T. instead of mention of any town.

No. 450/17/2017-Cus-IV Dt. 07.11.17 sent to various Central Excise and Customs
formations.
2. With due regards, it is to submit that
the views of the Association may also kindly be taken for due consideration before arriving at final
decision on the issue. The only way on the issue seems to form independent
Customs Commissionrates/formations/divisions/houses manned by Central Excise
personnel to reassign Customs functions to them falling under the erstwhile
Central Excise/CGST jurisdictional area.

The best way, however, seems to unify the Central Excise/CGST and Customs
grades at group ‘B’ and ‘C’ levels like already existing in Group ‘A’. The
Association has already given its submissions on the issue of unification on
various occasions.
4.
In view of the above, it is also requested to give an appointment to the Association to place view points on the subject mentioned issue in person before
your goodself/Board.

Sub: Distribution of assessees between
Centre and States.
Madam,
With
due regards and inviting your kind attention to the Ref. No. 142/AIB/E/17 Dt.
05.11.17 of the Association too, it is to submit that the work of the distribution
of assessees has been started in r/o GST. In Uttar Pradesh, the distribution of
pre-existing assessees with the Central Government has been made in the manner
that the units with about 65% of revenue have been transferred to State
Government including big revenue paying units. But this distribution doesn’t
seem justifiable as far as the transfer of the assessees pre-existing with the
Central Government is concerned. We are not aware of the revenue position of
the assessees transferred/to be transferred to the Central Government from the
State Government.
2. It
also seems that this distribution has been done without waiting for any formal
communication from the Board. Further, it seems that the formula for the
distribution of assessees is yet to be finalized by the GST Council.
3. If the
distribution is done without keeping in mind the revenue position to be with
the Central Government after the distribution, the same will neither be in the
interest of the Central Government nor CBEC particularly keeping in view the
compensation clause for State Governments. It will also affect the career
prospects of the workforce of the CBEC for the want of
functional justification.
4. No need to
submit that the Association has been making continuous submissions on the issue
of the distribution of the assessees between Centre and States and it was
assured that “neither the man power will be reduced under GST nor the career
prospects of our officers will be affected adversely on the implementation of
GST”.
5. In view of the
above, it is requested to follow a justifiable formula for the distribution of
the assessees between the Centre and States duly keeping the interest of the
Central Government, CBEC and man power of the CBEC intact without transferring
the pre-existing bigger assesses to the States in the interest of the revenue
of Central Government.
