DPC

Dear friends,
namaste.
            I am getting regular calls about the DPC for the post of Asstt. Commissioner. It was expected to be held at any time in the month of March-April but couldn't happen in March due to some legal stay. The matter is being pursued very vigorously for its administrative as well as legal resolution. The CBEC has already filed a SLP and also an IA in the Supreme Court for early DPC subject to the final verdict in SLP. An IA has also been filed by the Association for an early DPC subject to the final verdict of SLP.
           Now, matter has been posted for 11.04.18 by Supreme Court. Unfortunately, some petition has also been filed By Sh. Manimohan opposing the issue of early DPC. He has sought the implementation of Parmar case before conduction of the DPC. No need to say that the issues relating to seniority including Parmar or any other case/s should be resolved at the earliest in the manner that no injustice is done to any body/category but it would certainly take time being a lengthy process first requiring review DPCs at local levels by all CCAs of Customs as well as Excise/GST including all cadres upto the level of Superintendent and then recasting of All India Seniority List. So, the best way is the holding of DPC subject to the final verdict/implementation because of the promotions being affected merely on ad hoc basis and our officers being retired without promotion on monthly basis.
           Now, after opposition by Sh. Manimohan and associates, it is apprehended that the case may be lingered on further delaying the DPC; however, the Supreme Court has placed it for 11.04.18 for finalisation. If finalised, we don't know what the final fate would be. Before filing the objection by Sh. Manimohan and associates; it was, however, expected that Supreme Court would be pleased to grant the due permission for the DPC. It seems now that we would require to hire a good senior advocate for early DPC subject to the final verdict/implementation in the matter. No need to say that it would require hefty funds, the best way for which is the immediate collection of legal funds for this case by we all and particularly by those officers whose names already figure in the consideration zone. Contribution in thousands will enable us to collect funds in lacs to hire a good senior advocate. The details of the account of the Association are as under-
