Madam,
            Kindly refer to the following letters (copies enclosed) on the subject of “Postings in the cadre of Group ‘A’ – Reg.”-
(i) C.No.II/3/12/2017/Esstt. CCP Dt. 07.05.18 of Sh. Sumit Kumar, the Commissioner of Customs Preventive, Cochin and
(ii) F.No.S45/6/2010/Estt. Cus. Dt. 07.05.18 of Sh. Sumit Kumar, Commissioner of Customs, Cochin.    
            2. It is to submit with due regards that the direct recruit Group ‘A’ officers have been advocated to be posted with him by Sh. Sumit Kumar. The Association is really unable to understand the difference between the capability & expertise of direct recruit and promotee Group ‘A’ officers. As far as the expertise as well as capability is concerned, no need to say that there is only difference that the promotee Group ‘A’ officers have more expertise as well as capability on account of having huge experience than any direct recruit Group ‘A’ officer of equivalent grade. The importance of the experience has also been admitted by Sh. Sumit Kumar but side by side, he has given importance to direct recruits over the experienced promotees.
            3. No need to submit that the preferential treatment given to the direct recruits by Sh. Sumit Kumar is indicative of disrespect, discrimination, derogation and defamation to promotee officers in our democratic system. The Association is really unable to know about the mindset of Sh. Kumar but it is true that this seems the proper time to be headed the organization of CBIC as well as the field formations by the IAS officers instead of IRS officers having such discriminative mindset.
            4. Perhaps such mindset is the only reason that all Human Resource policies seem to be formed only in the interest of direct recruit Group ‘A’ officers by our CBICThis seems the only reason that the most of our officers are forced to retire at Group ‘B’ gazetted level instead of reaching PB4 levels like our counterparts of CBDT, CSS etc. after joining the job of Inspector, whether by direct recruitment or by promotion. This is the only reason that only temporary posts of Asstt. Commissioner have been created for promotee officers and only for a limited period with a horrible and discriminative rider that the officers promoted against these posts would have no right of further promotion. Not only it, this is the only reason that the said temporary posts have not been included in the Group ‘A’ IRS recruitment rules with the intention to treat the officers promoted against the said posts simply in lower manner considering them still Group ‘B’. And this is the only reason that promotee Group ‘A’ officers are not being given the democratic rights in the matters of infrastructure and prescribed official facilities and other immunities including office space, official vehicles, postings etc. The same scenario seems in the disciplinary matters, implementation of court orders and other issues. Thus, we may say that this is an approach having partiality and favouritism towards the direct recruit Group ‘A’ officers. It seems that our CBIC is made for only direct recruit Group ‘A’ officers.   
            5. In view of the above, it is very much requested to take the due measures to change the said “mindset” of our senior Group ‘A’ officers considering particularly that your goodself is heading CBIC as its Chairperson on whom the promotee as well as direct recruit officers of every grade have equal right in “the greatest democracy of the world”. Sh. Sumit Kumar is also requested to kindly disclose what special has been seen by him in direct recruit Group ‘A’ officers or it’s merely a case of partiality and favouritism.
