Kindly refer to the Ref. No. 190/AIB/DPC/17 Dt. 28.12.17, 44/AIB/G/18 Dt. 19.02.18, 59/AIB/G/18 Dt. 01.03.18, 66/AIB/D/18 Dt. 15.03.18, 92/AIB/D/18 Dt. 02.04.18, 110/AIB/G/17 Dt. 27.04.18 etc. of the Association.
            2. First of all, the Association is thankful to your goodself and all concerned authorities to initiate the process of the DPC. Further, it is to submit with due regards that the DPC is being conducted only for approximately 600 posts as per the affidavit filed in the Hon’ble Supreme Court by the CBEC. Not only it, the DPC is being convened only for the years 2016-17 and 2017-18 whereas the DPC for the year 2018-19 has also been already due and was supposed to be held in the month of January, 2018 as per the DOPT OMs No. 22011/1/2011-Estt.(D) Dt. 23.04.15, 22011/9/98-Estt (D) Dt. 08.09.98, 22011/1/2011-Estt (D) Dt. 11.03.11, 22011/1/2011-Estt (D) Dt. 13.12.13, 22011/1/2011-Esstt(D) Dt. 27.10.16 etc.
            3. As far as the number of vacancies is concerned, your kind attention is invited to the information provided under RTI by the CBEC vide F. No. 8/B/03/HRD (HRM)/2014/Pt. 1/6084 Dt. 27.04.18 (copy enclosed) based on the disposition list upto March, 2018 disclosing that there exist 12, 3, 77, 6, 426 & 1424 vacancies respectively for the post of PCC, CC, Pr. Comm., Comm., ADC/JC & DC/AC as on 31.03.18. Thus, no need to submit that all of the vacancies disclosed in the RTI reply belong upto the year of 2017-18 only and the vacancies for the year 2018-19 have not been depicted in it. 
            4. The information provided under RTI reflects that there exist 643 (12+3+77+6+426+119) vacancies above the level of Asstt. Commissioner. As per DOPT OM No. 22011/9/98-Estt(D) Dt. 06.10.99, the chain vacancies on account of cascading effect from higher side are also required to be included for the promotion to the post of Asstt. Commissioner. Thus at least 322 (half of 643) vacancies are also required to be taken in consideration for the purpose of DPC.
            5. Further, the RTI information discloses that 1305 posts are vacant at the level of Asstt. Commissioner itself as on 31.03.18. If the upward movement from the temporary posts to vacant regular ones is affected, no need to submit that all posts come to be vacant at the level of temporary Asstt. Commissioner. It is reiterated that the vacancies relating to the year 2018-19 are not included in it.
            6. It is also worth to mention that the provisions under GFR 254 of 2005 say that the vacant posts on account of the want of the eligible officers at higher levels can be operated at lower level. Accordingly, the vacant posts at higher levels may also be operated at JTS level to give the benefit of promotion to the maximum number of officers.
            7. No need also to mention that the temporary posts of Asstt. Commissioner will lapse in the month of December, 2018. Nobody also knows when the next DPC for the post of Asstt. Commissioner will happen. So, maximum number of posts including the year 2018 are required to be taken into consideration for the purpose of DPC. 
8. In view of the above and keeping particularly in view that our officers are forced to retire without the rarest IInd promotion, it is requested to kindly conduct the DPC for the post of Asstt. Commissioner duly taking into consideration the above made submissions-
i) Including the year 2018,
ii) Against all unfilled/existing/anticipated posts of Asstt. Commissioner (at least 1305+322+vacancies for the year 2018) including promotion quota against regular/permanent posts, retirements, demise, backlog etc. vacancies,
iii) Also taking into account the chain vacancies due to cascading effect from higher side,
iv) And also taking into account the vacancies invoking the provisions of GFR 254 of 2005.
No need to submit that the DPC against the maximum number of vacancies will not only give the benefit of promotion to the maximum number of officers but it will also provide the due manpower for GST work to the CBEC.
