Sub: Cadre Review process.
Sir,
It is to
submit with due regards that there exist the provisions only for the cadre
review of Group A as on date.
Whenever the cadre review/cadre restructuring in any department, particularly
in Central Board of Excise & Customs (now Central Board of Indirect Tax
& Customs) is done, the interests only of Group A are looked after.
2. This practice of looking after the interests only
of Group A is prevalent perhaps due to the fact that there exist no provisions
for the cadre review for Group B or C which are required to be formulated as the
urgent need of time. No need to submit that the main purpose of a cadre
review is to restructure a cadre in such a way as to remove the deficiencies
which might be existing at the time of the constitution of a service or have
crept in subsequently and ensure that the cadre structure satisfies the
functional, structural and personnel considerations. Cadre review provides an
opportunity to overcome various bottlenecks, remove existing distortions and
bring about rationalisation of cadre structure so as to improve the efficiency
and morale of the cadre officers as well as to avoid promotional blocks and also to harmonise the functional needs with the
legitimate career expectations of cadre members and thereby enhance the
effectiveness of the service in the fulfilment of the objectives for which it
has been established.
3. Unfortunately,
no such process of cadre review has ever been observed particularly in Central Board of Excise & Customs (now
Central Board of Indirect Tax & Customs) for Group B or C officers fulfilling
the main purpose for these cadres as submitted under para 2 above. Here, the most of the officers
joining as Inspector of Central Excise in Level-7 are forced to retire merely
after one promotion at the post of Superintendent in Level-8 whereas their
counterparts appointed in Level-7 including Customs, CBDT, CSS, Rajya Sabha
Secretariat etc. are easily being promoted to the Level-13 and Level-14.
4. It is also well
pertinent to mention that there is no direct recruitment at Group A entry level
in the developed countries like UK, France etc. which is the only reason that
Inspector or even lower level officers reach the top positions in these
countries because of their interests being duly looked under cadre review/cadre
restructuring.
5. In view of the
above, it is requested to kindly take necessary steps for the cadre review particularly
for the officers who joins/have joined the Central Board of Excise & Customs as Inspector of
Central Excise to fulfill the main purpose as submitted under para 2 above alongwith
the cadre review of the Group A and also formulate the provisions for the cadre
review for Group B and C in general enabling them to reach top levels.

It is to
submit with due regards that the cadre review proposal for CBIC is to be submitted upto
December’ 2018 as per DOPT OM issued vide F. No. I. 11019/9/2018-CRD Dt.
25.05.18. It is further to submit that the interests only of Group A are looked
after, whenever the cadre review/cadre restructuring happens in the Central Board
of Excise & Customs (now Central Board of Indirect Tax & Customs).
2. No need to submit that the

RRs of Central Excise Superintendents.
Dear
Sir,
Kindly refer to the draft RRs of
Central Excise Superintendents being circulated on social media as well as Ref.
No. 144/AIB/P/18 Dt. 13.06.18 and Ref. No. 129/AIB/E/18 Dt. 28.05.18 (both
addressed to you) of the Association alongwith others on RRs.
2. In the said draft RRs, the
qualifying service for the promotion from Inspector to Superintendent has been
mentioned as three years for field formations whereas it has been put only two
years under the draft RRs meant for the Superintendents working in the
Directorates under CBIC issued vide letter F.No. 10A12/1/2018-Ad.IIB Dt.
04.06.18. The Association has also been informed vide letter F.No.
10A60/28/2018-Ad.IIB Dt. 08.05.18 in response to CPGRAM registration No.
CBOC/E/2018/01085 Dt. 28.03.18 that amendment in eligibility criteria to 2
years for promotion of Inspectors of Central Excise to Superintendent has been
approved by DOPT.
3. Further, it will be a clear
discrimination if the eligibility is made same not only for above both
categories but also for Central Excise Inspectors, Preventive Officers and
Examiners which is to be only 2 years as per the DOPT OM No.
AB-14017/61/2008-Estt.(RR) Dt. 24.03.09.
4. Inviting your kind attention to
the verdict given in OA No. 2323/2012, the RRs are to be reframed to bring all
the Inspectors (i.e. Inspectors of Central Excise, Preventive Officers and
Examiners of Customs) recruited in a particular year through All India Combined Examination in
parity to maintain the principle of equal opportunity & equality before law and to save the senior
Central Excise officers from humiliation of working under their juniors of
Customs belonging to the same cadre of Inspector in CBEC.
5. Accordingly, it is requested to
do the needful in the matter taking the due consideration of all submissions
made by the Association on the issue.
