            Kindly refer to the following letters of the Association on the above matter-

            2. It is to submit with due regards that the Association filed the said OA seeking amendments/revision of the Recruitment Rules to bring all the Inspectors (i.e. Inspectors of Central Excise, Preventive Officers and Examiners of Customs) recruited in a particular year through All India Combined Examination in parity to maintain the principle of equal opportunity & equality before law and to save the senior Central Excise officers from humiliation of working under their juniors of Customs belonging to the same cadre of Inspector in CBIC. Accordingly the Govt. undertook before the Hon’ble CAT that the amendment of the Recruitment Rules to the said effect is already under process.
            3. The Hon’ble CAT has directed to expedite the process of amendment of the Recruitment Rules by taking effective steps for Notification of the Recruitment Rules, within a reasonable period, preferably within four months from the date of the receipt of a copy of the order. In this regard, it is worth to mention that the four months time has already expired year ago but the directions of the Hon’ble CAT have not been followed. It is also worth to mention that the Association has no option except going to the contempt in the matter as being advised by the advocate.
            4. In view of the above, it is requested to kindly expedite the finalization of the Recruitment Rules at an early date to bring all the Inspectors (i.e., Inspectors of Central Excise, Preventive Officers and Examiners of Customs) recruited in a particular year through All India Combined Examination at par in the matter of promotions to save the senior Central Excise/GST officers from humiliation of working under their juniors of Customs.

Sub: Verdict given in OA No. 684/2018 by Principal Bench of Hon’ble CAT on 09.02.18.
Sir,
Kindly refer to the letter Ref. No. 54/AIB/P/18 Dt. 22.02.18 of the Association.
2. With due regards, it is to submit that the said OA was filed by the Association to remove the disparity in the Pay Scale of promotional post for Central Excise/CGST Superintendents with a prayer to promote the applicants and other similarly situated Central Excise/CGST Superintendents and promotee Assistant Commissioners to Senior Time Scale bringing them at par with other similar posts including Narcotics Control Bureau, CSS etc.
            3. The Hon’ble CAT has directed to take a decision on the representation of the Association by passing a reasoned and speaking order within a period of three months from the date of the receipt of the copy of this order.
4. In this regard, it is worth to mention that the three months time has already expired but the directions of the Hon’ble CAT have not been followed. As per the legal advice, it is a contemptuous action not to follow the directions of the Hon’ble CAT.
5. In view of the above, it is requested to kindly expedite the matter by promoting the Central Excise/CGST Superintendents and promotee Asstt. Commissioners directly to a senior group ‘A’ post (STS), i.e., Deputy Commissioner, like many other counterparts of them including NCB, CSS etc. and they may also kindly be given due weightage of the service rendered in group ‘B’.
