Sub: Transfer of the General Secretary of Kanpur Unit
of the Association.

Kindly refer to the letter Ref. No.
187/AIB/A/18 Dt. 26.07.18, 188/AIB/A/18 Dt. 27.07.18 and 189/AIB/A/18 Dt.
27.07.18 of the Association regarding the transfer of the office bearers of Patna-Ranchi-Jamshedpur
and Guntur Associations.
2. With due regards, it is again to submit that Sh. Ashish
Vajpeyee, the General Secretary of the Kanpur Unit of the Association, has also
been transferred out of the Headquarters under the AGT orders of 2018 issued
for the Kanpur Commissionerate on 22.06.18.
3. It is also worth to mention that this All India
Body of the Association is having its local units/branches throughout the
country as per the RSA Rules, 1993. The office bearers of
the branches attend all issues/grievances of the members and the issues
relating to the welfare activities on day-to-day basis by bringing the same
before the concerned Authority for the due redressal.
4. It is further to submit that the
non-retention/posting of the office bearers at Headquarters not only jeopardises
the staff-welfare activities but also delinks the Association from the
administration to help in solving the staff grievances and other relevant
issues. This will also result into the failure of the staff grievances
redressal mechanism, if the office bearers of the Associations are transferred
out of the Headquarters. By this, the very purpose and soul of forming the
Service Associations under RSA Rules are also defeated.
5. Your kind attention is also invited to the MHA OM
No. 23/3/69-Estt (B) Dt. 08.04.69 reiterated vide CBIC letters F. No.
B-12014/1/01-Ad.III-B Dt. 27.10.92, F. No. A-35017/28/92-Ad.III-B Dt. 30.06.94
and F. No. A-35017/01/2014-Ad.III-B Dt. 29.01.14 regarding the transfer of
the office bearers of the Association. The said communications say that the
Chief Executive or General Secretary and two more office bearers of the
Association would not be transferred out of the Headquarters. The same thing
has again been reiterated vide the DOPT ID No. 16/18/2008-JCA Dt. 01.12.09.
6. Moreover, Sh. Vajpeyi has been transferred out of
Kanpur without completion of mandatory eight years as specified in the Zonal
Transfer Policy, 2018 of the Lucknow Zone. Also despite of the fact that the
Zonal Transfer Policy specifically exempts any officer from transfer to
outstation if his/her ward is studying in 10th or 12th
standard, the General Secretary of the Association has been transferred out of
Kanpur. Thus, not only his daughter is studying in 12th standard
but he has also not completed his tenure at Kanpur and has been transferred
to Farrukhabad, a Division office situated 150 Kilometers from Kanpur. No need
to submit that his transfer out of Kanpur would affect the welfare activities
of the Association in very adverse manner.
7. In view of the above, it is requested that the office bearers of the Association may
kindly not be transferred out of the Headquarters and the transfer orders of
Sh. Vajpeyi may kindly be cancelled by retaining him at Kanpur itself. It is
also requested that the office bearers of the Patna-Ranchi-Jamshedpur and
Guntur Associations may also kindly be retained at Headquarters offices by
cancelling their transfer orders.

Sub: Request for uniform/common formula for pay
benefits in r/o VIth as well as VIIth Pay Commission.
Sir,
Kindly
refer to earlier letter Ref. No. 139/AIB/P/18 Dt. 05.06.18 of the Association.

It is to submit again with due regards that the Pay Bands and Grade Pays were
created replacing the pay scales as a result of the implementation of the
report of the VIth Central Pay Commission. As a result of the implementation of
the report of the VIIth Central Pay Commission, the pay band/grade pay system
was changed to pay matrix/pay level system.

The formula to decide the pay benefits for different categories of the
employees was not uniform for the implementation of the report of any of these
Pay Commissions. No need to say that the lower cadre officers were granted
lower pay benefits and the higher ones were granted the higher pay benefits but
the formula for the fixation of the pay for all categories was not uniform/common.
This differentiation between the pay formulae for fixation of their pays gave
rise to the discrimination in the greatest democracy of the world.

There was a great jump from PB3 to PB4 in comparison to the Pay Bands meant for
the lower cadres when the report of the VIth Pay Commission was implemented.
Again fitment formula was enhanced to 2.67 for Level-13 whereas it was kept
merely 2.57 for lower levels for the implementation of the report of the VIIth
Pay Commission. Thus, the gazetted officers of the level of Grade Pay of Rs.
8700/- (Level-13) and above were not only benefitted extraordinarily in the
terms of the jump from PB3 to PB4 (Level-12 to Level-13) but were also
benefitted in terms of the enhancement of the fitment formula resulting in the
discrimination to other lower cadres, gazetted as well as non-gazetted.

In view of the above, it is requested to look into the matter for the sake of
uniform/common formula for pay benefits for all employees in terms of the jump
from one Pay Band/Grade Pay/Pay Matrix/Pay Level to other as well as fitment
formula regarding the implementation of the reports of VIth as well as VIIth
Pay Commission to give the due justice to the lower cadres.

Kindly refer to the earlier requests
of the Association including Ref. No. 150/AIB/P/18 Dt. 15.06.18 and 152/AIB/P/18 Dt. 17.06.18 on the subject matter.
2.
It is to
submit with due regards that the DPC for the transition year 2018 is still
pending and already overdue as it was to be convened between 15.07.17 to 30.11.17
as per the DOPT
OM No. 22011/14/2013-Estt(D) Dt.08.05.17.
3. It
is also worth to mention that the temporary posts of Asstt. Commissioner would
lapse in the month of December, 2018. Also the very first DPC against these
posts was conducted after one year of the creation of the same resulting in the
retirement of our officers without promotion despite of thousands of
promotional posts being in hand. Again, it is apprehended that the officers
will keep retiring despite of the promotional posts being in hand if the DPC
for the transition year 2018 is not conducted. So, the convening of the DPC for
the transition year 2018 is immediate need of the time whether these posts are
extended or not. The promotion to the maximum
possible number of our officers against these posts is even in the interest of
the manpower requirement under the GST.
4. Your kind attention is also
invited to the DOPT OM issued vide F.No.36012/11/2016-
Estt.(Res-I) {Pt-II} Dt. 15.06.18 issued as per the directions of the Hon’ble
Supreme Court on the issue of the reservation paving the way to affect the
promotions against the vacancies kept unfilled for the purpose of reservation. The DPC against these
posts is required to be convened at an early date to give the benefit of the
promotion to the maximum number of officers.
5. In view of the above, it is requested-
(a) To conduct the DPC for the
post of Asstt. Commissioner for the transition year 2018 immediately to benefit the
maximum number of our officers and save them from
the humiliation of retiring after single promotion as
well as to provide due manpower at group A entry level for GST work.
(b) To conduct the DPC
for the post of Asstt. Commissioner against all
vacancies kept unfilled for the purpose of reservation.

Sub: Review DPC for the post of Asstt. Commissioner for the
years 2016-17 & 2017-18.

Kindly refer to the letter Ref. No. 156/AIB/T/18 Dt. 20.06.18
of the Association.
2.
It is to submit with due regards that many of the officers,
who have already taken VRS, unfortunately expired etc., were promoted as per
the result of the DPC
for the year 2016-17 and 2017-18 for the post of
Asstt. Commissioner on account of providing the incomplete or wrong information by the
field formations.
3. Thus, many of the due officers have not been
promoted due to providing wrong/incomplete information by the field formations
without any fault being on the part of the concerned officers.
4. In view of the above, it is requested to conduct the review
DPC for the post of Asstt. Commissioner for the years 2016-17 and 3017-18 to
promote-
(i) Equal number of officers in lieu
of the officers who have been promoted despite of taking VRS, unfortunately
expired etc.
(ii) Officers in r/o whom wrong/incomplete information was
been provided by the field formations.
