Your kind attention is invited to
the Office Orders numbered 107/2018 and 108/2018 both Dt. 03.07.18 of CBIC
alongwith the letter Ref. No. 174/AIB/T/18 Dt. 09.07.18 of the Association.
2. Further, the following
submissions are made with due regards for due redressal:
(i)
The transfer policy has not been followed as there exist many deviations from
the policy.
(ii) The officers are very much demoralised due to the deviations and
non-consideration of their requests which will affect their professional abilities, further hampering the performance.
(iii) Whereas many recently promoted Asstt. Commissioners with more than 3 years of service have been
allowed to
continue at the
existing station/zone (which is really a
very good thing), many of
the officers retiring
within 3 years have not been brought to their requested stations. The policy says that the officers who have 3
or less years of service left shall be posted to the
station/region of their choice.
(iv) Genuine compassionate grounds
including medical ones of self as well as family members have not been given
due consideration.
(v)
The policy being followed in 2017 & 2018 is totally different from the
policy followed in 2014.
(vi)
The postings in Directorates have been made based on recommendations instead of
following the policy.
(vii)
The policy says about the change of station whereas the zones have been
changed.
3. It is also worth to mention that
these officers have been promoted against the temporary posts of the Asstt.
Commissioner with the clause of “no
further promotion” and also not being included in the recruitment rules. The
officers didn’t get the benefit of even a single paisa on being promoted
against these posts at the fag end on account of already working in the same
pay scale. Many of them rather forced to get less emoluments on account of
being transferred to the cities with less HRA. Due to this reason, a good
number of the officers preferred to forgo the promotion against these posts and
many are forced to plan to be voluntarily retired.
4. In view of the above, it is
requested to kindly review the transfer orders with the due sympathy
particularly giving due consideration to the representations/willingness of the
officers.

Sub: Cadre Restructuring in CBIC.
Sir,
It is to
submit with due regards that there exist the provisions only for the cadre restructuring
for
Group ‘A’ as on date.
Whenever the cadre review/cadre restructuring in any department, particularly
in Central Board of Indirect Tax & Customs (CBIC) is done, the interests
only of Group ‘A’ are looked after.
2. This practice of looking after the interests only
of Group ‘A’ is prevalent perhaps due to the fact that there exist no
provisions for the cadre review for Group ‘B’ or ‘C’ which are required to be
formulated as the urgent need of the time. No need to submit that the
main purpose of a cadre review/cadre
restructuring is to restructure a cadre in such a way as to
remove the deficiencies which might be existing at the time of the constitution
of a service or have crept-in subsequently and ensure that the cadre structure
satisfies the functional, structural and personnel considerations. It provides
an opportunity to overcome various bottlenecks, remove existing distortions and
bring about rationalisation of cadre structure so as to improve the efficiency
and morale of the cadre officers as well as to avoid promotional blocks and also to harmonise the functional needs with the
legitimate career expectations of cadre members and thereby, enhance the
effectiveness of the service in the fulfilment of the objectives for which it
has been established.
3. Unfortunately,
no such process of cadre review/cadre
restructuring
has ever been observed particularly in the CBIC for Group ‘B’ or ‘C’ officers fulfilling the main purpose for
these cadres as submitted under para 2 above. Here, the most of the officers
joining as Inspector of Central Excise in Level-7 are forced to retire merely
after one promotion at the post of Superintendent in Level-8 whereas their
counterparts appointed in Level-7 including Customs, CBDT, CSS, RajyaSabha
Secretariat etc. are easily being promoted to the Level-13 and Level-14.
4. It is also well pertinent to mention that it was approved
and recommended by the Cabinet in 2013 at the time of last cadre restructuring
of CBIC to bring a scheme for Group ‘B’ Central Excise executive officers
independent of cadre restructuring
to remove their stagnation but unfortunately,
nothing has been done till date even after the expiry of around five years.
5. In view of the
above, it is requested to kindly take necessary steps-
(a) For the cadre
review/cadre restructuring particularly for the
officers who join/have joined the CBIC as Inspector of Central Excise to fulfill the
main purpose as submitted under para 2 above alongwith the cadre review/cadre
restructuring of the Group ‘A’.
(b) Also formulate the provisions for the
cadre review/cadre restructuring for Group ‘B’ and ‘C’ in general enabling them
to reach top levels.
(c) To implement the recommendations of the Cabinet to bring a scheme for Group ‘B’ Central
Excise executive officers to reach them Level-13 & 14 like other
counterparts before the processing of the current cadre restructuring in CBIC.
