Sub: The order Dt. 09.02.18 of the Hon’ble CAT, PB, New Delhi in OA No. 684/2018 & MA No. 747/2018 filed by All India Association of Central Excise Gazetted Executive Officers Vs. UOI & Ors before Hon’ble CAT, PB, New Delhi.

            Kindly refer to the Order issued vide F. No. A-23011/26/ 2018-Ad.IIA Dt. 14.09.18 of the CBIC on the above subject.
2. It is to submit with due regards that the merits of the issues seem not to be duly considered. The submissions made by the Association vide Ref. No. 54/AIB/P/18 Dt. 22.02.18 just after the order of the Hon’ble CAT have also not been paid any heed. No heed has also been paid to the discrimination & disparity being faced by the applicants and the members of the Association. It is also reiterated that the grounds & submissions made in the OA have also not been considered which require a detailed parawise speaking order disposing every para of OA on merit instead of mentioning the observations made by CPC as the observations/recommendations of the CPC are never binding to the government. No need to say that the government is free to take any decision independent of the observations/recommendations of the pay commission to grant justice to its employees. This is the only reason that all recommendations of the pay commission are never accepted by the government; some are accepted, some are amended and some are not accepted.
3. Further, it is not the question of dilution of Group ‘A’ service. The actual question is the grant of justice to the applicants and the members of the Association. Moreover, it is reiterated that there would be no dilution of the Group ‘A’ service, if our Superintendents/applicants/members of the Association are promoted directly to a STS (GP-6600) post like the most of other gazetted group ‘B’ officers.
4. The burning example is CPWD, where the officers are being promoted from GP-4600 to GP-6600 directly and further to GP-8700. The most interesting thing is that Group ‘A’ direct entry is also in GP-5400/PB3 there like our CBIC. As far as the residency period is concerned, the same may be changed accordingly in consonance of the DOPT provisions.
5. Two more issues have been touched alongwith the issue of promotion of our officers to a STS post in the above referred letter of the CBIC, one is regarding pay scale of our Superintendents and another is regarding NFU to our officers to grant them financial parity with the counterparts of CSS. But it seems that the same are also have not been dealt with judicious approach to give justice to our officers. These issues have also been disposed without giving due consideration to the submissions made by the Association.
6. No need to submit that all issues are required to be decided based on merit considering every para submitted by the Association in its all relevant representations. It is also reiterated that all of the issues have already been recommended by the CBIC. Now, disposing these issues negatively is against all principles of the natural justice. It is really unfortunate that our own CBIC is now rejecting the issues which are already duly recommended ones by CBIC itself.    
7. In view of the above, it is requested to kindly reconsider the above issues for the sake of granting justice to our own officers.
