Sub: Proposal for Cadre Restructuring-2019 of CBIC – regarding.

Sir,

Kindly refer to the letter Ref. No. 54/AIB/CR/21 Dt. 09.04.21 of the Association.

2. It is again submitted with due regards that a proposal for separate service (IRS Branch B) for our officers has been recommended by the CBIC but the number of posts in this proposed separate service are required to be enhanced at each level. This can be done by optimizing the number of posts at Commissioner level and abolishing the posts above the level of Commissioner.

 3. It is reiterated that only one Commissioner is working in the state governments under GST without any post above this level. Contrary to it, huge number of posts exist at the level of Commissioner and above in the CBIC in Central Government without any functional requirement under GST. So, immediate steps are required to minimize the posts at the level of Commissioner and abolish all posts above the level of Commissioner in Central GST to utilize the same for matching saving to enhance the posts in IRS Branch B.  

            4. The injustice done to our officers is clear from the fact that the CBIC has proposed the posts of Deputy Commissioner more in number (677) than even the sanctioned strength of the direct recruit Asstt. Commissioners (624) whereas only 350 posts of Deputy Commissioner have been proposed for 3092 promotee Asstt. Commissioners. Not only it, the CBIC has merged the posts at the level of Joint Commissioner and Additional Commissioner to grant Non Functional Grade to direct recruit Asstt. Commissioners on Ist day of 14th year whereas they not only bifurcated the posts at these levels but also proposed meager number of posts to deprive the promotee Asstt. Commissioners from promotions as well as Non Functional Grade. Likewise, CBIC proposed only nine posts of Commissioner for 3092 promotee Asstt. Commissioners whereas they proposed 497 posts of Commissioners and above for 624 direct recruit Asstt. Commissioners instead of proposing the posts in the proportion of the cadre strength of both categories.

In the last cadre restructuring, CBIC got created good number of extra posts for Group A officers at each level despite of the required number of the eligible officers not being available for promotion. It is also worth to mention that the career prospects of the direct recruit IRS officers have been improved even better than IAS on account of the excess number of posts created at various levels in the last cadre reviews and repeated relaxations sought from the DOPT. Even seven years direct recruit Asstt. Commissioner has become Joint Commissioner in CBIC on account of excess posts created at all levels and relaxations sought from the DOPT. No such steps have ever been taken by the CBIC to improve career prospects of our officers, the most of whom are retiring with single promotion.

6. On the point of enhancing the number of posts in IRS Branch B meant for our officers, CBIC may pretend that the eligible number of officers would not be available to get promotions against the enhanced posts. If they pretend so, it will never be true because our officers appointed as Inspector are very well eligible to become Commissioner within 20 years of service as per the DOPT guidelines. The qualifying services/residency periods prescribed as per DOPT OM No. AB-14017/61/2008-Estt.(RR) dt. 24.03.09 are mentioned as below for your kind reference-

(i) 2 years for promotion to a post of Level-8 (grade pay of Rs. 4,800/-) after joining as Inspector.

(ii) 7 years for promotion to a post of Level-11 (grade pay of Rs. 6,600/-) after joining as Inspector (There is no justification of promoting an officer from a grade pay of Rs. 5,400/- on account of time scale after 4 years of service to a post with same grade pay Rs. 5,400/- only. It is also submit-worthy that the most of the group ‘B’ gazetted officers including CSS are being promoted to a post with a grade pay of Rs. 6600/- instead of Rs. 5400/- in Central as well as State governments.).

(iii) 12 years for promotion to a post of Level-12 (grade pay of Rs. 7,600/-) after joining as Inspector.

(iv) 17 years for promotion to a post of Level-13 (grade pay of Rs. 8,700/-) after joining as Inspector.

(v) 20 years for promotion to a post of Level-14 (grade pay of Rs. 10,000/-) after joining as Inspector.

           (vi) And so on.

7. If even now it is thought that the eligible officers would not be available to be promoted against the enhanced number of posts in IRS Branch B, our officers may also be promoted after seeking relaxation from the DOPT as is being done in the case of direct recruit IRS officers.

8. In view of the above, it is requested to kindly create the promotional posts upto the highest level in IRS Branch B in the proportion of the strength of the direct recruit IRS officers at each level and IRS Branch B may kindly be started from the level of Inspector without bifurcating the posts at Joint Commissioner and Addl. Commissioner level and also promote our Inspector to the post of Addl. Commissioner on Ist January of 17th year of service. Three Group ‘B’ Executive streams may also be merged with retrospective effect to bring the officers of same year to same level of promotion and extra posts of Commissioner and all posts above the level of Commissioner be abolished for the purpose of matching saving to create sufficient posts in IRS Branch B at each level.
