Sir,

As per Newsletter issued by our Chairman of CBIC, it is submitted with due regards that the much awaited ensuing cadre restructuring proposal of CBIC is now with DOPT. A separate service (IRS Branch B) for our officers has been proposed in it by the CBIC on the pursuance by the Association but the number of posts in this proposed separate service are very little and are required to be enhanced at each level in proportion of the cadre strength of our officers. This can be done by optimizing the number of posts at Commissioner and abolishing the posts above the level of Commissioner as there is no functional justification to keep these posts as per GST Act.

 2. Under GST, only one Commissioner of state level is working in the state governments with no post above this level. Contrary to it, huge number of posts exist at the level of Commissioner and above in the CBIC under Central Govt. without any functional requirement under GST. So, immediate steps are required to be taken to minimize the posts of Commissioner in Central GST. Further, these posts are required to be distributed in the proportion of the respective cadre strength between DR IRS officers and promotee officers. As far as the posts above the level of Commissioner are concerned, all of these posts are required to be abolished having no functional justification under GST. Such abolishing of these posts and minimizing the posts of Commissioner should kindly be utilized for matching saving to enhance the posts in IRS Branch B meant for promotee officers upto the highest level. The ratio in the hierarchy should also be reasonable as per the DOPT norms and it should not be less than 1:3.

            3. As per the copy of the cadre restructuring proposal provided to the Association, the injustice done to the promotee officers is clear from the fact that CBIC have proposed the post of Deputy Commissioner more in number (677) than even the sanctioned strength for the direct recruit Asstt. Commissioners (624) whereas only 350 posts of Deputy Commissioner have been proposed for 3092 promotee Asstt. Commissioners. Not only it, they have merged the posts at the level of Joint Commissioner and Additional Commissioner to grant Non Functional Grade to direct recruit Asstt. Commissioners on Ist day of 14th year calculated from the year following the year of examination whereas they not only differentiated the posts at these levels for promotee officers but also proposed meager number of posts for promotee officers to deprive them from promotions as well as Non Functional Grade. Likewise, they proposed only 9 posts of Commissioner for 3092 promotee Asstt. Commissioners against 497 posts of Commissioners and above for 624 direct recruit Asstt. Commissioners instead of proposing the posts in the proportion of the cadre strength of both categories.

4. Thus, the number of the posts in IRS Branch B have been proposed neither in the desired number nor in the desired proportion. It is also worth to submit that the counterparts of our officers in our department of Revenue itself as well as other departments are already getting the promotions upto the level of Commissioner and Joint Secretary. In our sister organization of CBDT also under the same department of Revenue, our counterparts are already reaching the level of Commissioner. Not only it, our counterparts namely Examiners are also reaching the level of Addl. Commissioner and Commissioner in our own organization of CBIC despite of being belonged to the same cadre of the Inspector. The posts at Inspector level have been trifurcated by the CBIC without any valid reason which they have now proposed to be merged with prospective effect. This prospective merger is placing the officers recruited as Central Excise Inspector in worst position. So, this merger is required to be implemented from retrospective effect, i.e., from the date of trifurcation to bring the officers of same year of all of three categories of Inspector to same level of promotion.

In the last cadre restructuring, CBIC got created good number of extra posts for Group A officers at each level despite of the required number of the eligible officers not being available for promotion. It is also worth to mention that the career prospects of the direct recruit IRS officers have been improved even better than IAS on account of the excess number of posts created at various levels in the last cadre reviews and repeated relaxations sought from the DOPT. Even seven years direct recruit Asstt. Commissioners have become Joint Commissioner and seventeen years Asstt. Commissioner has become Commissioner in CBIC on account of excess posts created at all levels and relaxations sought from the DOPT. No such steps have ever been taken by the CBIC to improve career prospects of our officers recruited as Inspector (whether direct or promotee), the most of whom are retiring with single promotion. No cadre review has ever been done for these poor officers.

6. On the point of enhancing the number of posts in IRS Branch B meant for our officers, CBIC may pretend that the eligible number of officers would not be available to get promotions against the enhanced posts. If they pretend so, it will never be true because our officers appointed as Inspector are very well eligible to become Commissioner within 20 years of service as per the DOPT guidelines. The qualifying services/residency periods prescribed as per DOPT OM No. AB-14017/61/2008-Estt.(RR) dt. 24.03.09 are mentioned as below for your kind reference-

(i) 2 years for promotion to grade pay of Rs. 4,800/- (Level-8), i.e., Superintendent, after joining as Inspector.

(ii) 7 years for promotion to grade pay of Rs. 6,600/- (Level-11), i.e., Deputy Commissioner, after joining as Inspector (There is no justification of promoting an officer from a grade pay of Rs. 5,400/- on account of time scale after 4 years of service to a post with same grade pay Rs. 5,400/- only. It is also submit-worthy that the most of the group ‘B’ gazetted officers including CSS are being promoted to a post with a grade pay of Rs. 6600/- instead of Rs. 5400/- in Central as well as State governments. So, our Superintendents should also be promoted to Senior Time Scale post).

(iii) 12 years for promotion to grade pay of Rs. 7,600/- (Level-12), i.e., Joint Commissioner, after joining as Inspector.

(iv) 17 years for promotion to grade pay of Rs. 8,700/- (Level-13), i.e., Additional Commissioner, after joining as Inspector.

(v) 20 years for promotion grade pay of Rs. 10,000/- (Level-14), i.e., Commissioner, after joining as Inspector.

(vi) And so on.

7. If even now it is thought that the eligible officers would not be available to be promoted against the enhanced number of posts in IRS Branch B, our officers may also be promoted after seeking relaxation from the DOPT as is being done in the case of direct recruit IRS officers regularly.

8. It is also worth to mention that the separate service namely IRS Branch B has been proposed to mitigate the chronic and acute stagnation being faced by the officers being recruited as Inspector. Despite of it, this service has not been proposed from the level of Inspector. It is reiterated that this service should kindly be started from the level of Inspector on the lines of Central Secretariat Service (CSS) which is started from the level of Assistant, the analogous counterpart of our Inspector.

9. It is also worth to mention that the time scale/NFU/NFG was granted in the pay scale of Rs. 8000-13500/- after 4 years of regular service to the Section Officers of CSS in their cadre restructuring in 2003. They are first Group B officers to get the time scale/NFU/NFG. Now, they are getting it in Level 10 (GP of Rs. 5400/- in PB3) whereas it has been granted to our officers in GP of Rs. 5400/- in PB2. It is also worth to mention that the time scale/NFU/NFG is being granted to all of other Group B officers also in GP of Rs. 5400/- in PB3 except us. This fact was also placed before CBIC with the request to grant time scale/NFU/NFG to our officers in GP of Rs. 5400/- in PB3 in the ensuing cadre restructuring but no heed was paid by them to the request of the Association. So, it is requested that the time scale/NFU/NFG to our officers may also kindly be granted in GP of Rs. 5400/- in PB3 (Level 10) in ensuing cadre restructuring.      

10. In view of the above, it is requested to kindly consider the above submissions and-

(i)                 Start separate service namely IRS Branch B from the level of Inspector on the pattern of CSS where service starts from the level of Assistant, counterpart of our Inspector.

(ii)               Enhance number of posts at each level in IRS Branch B in proportion of cadre strength of our officers.

(iii)             Make ratio for promotions identical for direct Group A service and Branch B service. Number of promotional posts and feeder posts should be in the same proportion at each level in both services.

(iv)             Not bifurcate the number of the posts of Joint Commissioner and Addl. Commissioner in IRS Branch B and to promote our Inspector to the post of Addl. Commissioner on Ist January of seventeenth year of service.

(v)               Merge three Group B Executive streams with retrospective effect to bring the officers of same year of all of three categories of Inspector to same level of promotion.

(vi)             Abolish extra posts of Commissioner and all posts above the level of Commissioner.

(vii)           Grant time scale/NFU/NFG to our officers also in GP of Rs. 5400/- in PB3 (Level 10).
