Sub: Regularisation and issuance of the Seniority List of the Asstt. Commisioners

beyond 2012-13.

Sir,

Kindly refer to the earlier communications of the Association on the above matter.

2. It is submitted with due regards that the regularization has been made and Seniority List of the Asstt. Commissioners working under the CBIC issued only upto the year 2012-13. After it, all the officers promoted to the post of Asstt. Commissioner have been working on ad-hoc basis despite of being promoted against the long-term vacancies, whether the vacancy is regular or temporary.

3. It is further submitted that all vacancies/posts existing for more than six months are termed as long-term. It is also worth to mention that the officers can’t be forced to work on ad-hoc basis against long term vacancies. As per the DOPT guidelines, ad-hoc posts can exist only for six months, extendable by further six months only. The posts/vacancies extending beyond it can no way be termed as ad-hoc and are treated as regular. Accordingly, the officers working on these posts regularly for more than one year are also to be treated as regular. It is great injustice to them to treat as working on ad-hoc basis beyond one year.

4. Your kind attention is also invited to the regularization made and Seniority List of Asstt. Commissioner issued upto the year 2012-13. In it, retired officers were not considered seeking one time relaxation from DOPT due to the reasons and provisions known only to the concerned authorities. As per guidelines, the names of the retired officers are also required to be considered for the purpose.

5. It is also worth to mention that all ad-hoc promotions to all Group ‘A’ posts above the Asstt./Deputy Commissioner have already been regularized and the Seniority Lists issued. However, the officers who have been promoted from Group ‘B’ and working as ad-hoc Asstt./Deputy Commissioners are forced to retire as “ad-hoc” without any fault on their part for the want of regularization despite of being worked on long-term posts.

6. It is also mentioned further that the officers are being promoted to the temporary posts of Asstt. Commissioner as per the provisions of the Recruitment Rules of IRS. ‘Post’ defined under these rules includes both, temporary and regular. However, the officers are being promoted as ‘ad-hoc’ against both posts whether it is regular or temporary. So, officers promoted against regular as well as temporary posts are required to be regularized.

 7. In view of above, it is requested to kindly do the needful to-

(i) Update the reguarisation of ad-hoc promotions made to the post of Asstt./Deputy Commissioner at an early date, so that no officer is forced to retire as “ad-hoc” despite of being worked on long term post/vacancy.

(ii) Include the names of the officers also, who have worked or are working against temporary posts of Asstt. Commissioner, for the purpose of regularization and the issuance of the Seniority List.

(iii) Issue updated Seniority List of Asstt. Commissioners beyond 2012-13 at an early date and keep issuing the same every year.

(iv) Consider the retired officers also for regularization and issuance of the Seniority List in consonance of the DOPT guidelines/provisions.
