Sir,
In continuation to Ref. No. 50/AIB/T/24 Dt.
02.07.24 of the Association, it is again brought to your
kind notice with due regards that the Assistant Commissioners promoted in the
year 2020 were allotted Zones far from their parent Zones. Due to the
prevailing circumstances viz., aged & ailing parents, working spouses, children
education etc., they couldn’t get their families to new places and forced to
live alone facing a lot of hardships.
2. It is also worth to submit that the most of the officers have been promoted
and posted far away at the fag
end of their career. These old aged officers are prone to various old age
diseases and having regular treatment at the parent place. All of them are also
engaged to fulfill their family obligations like settlement of career issues of
young wards, settlement of marriage of their wards particularly daughters, care
of super-old and ailing parents being under medical supervision at the parent
place etc. due to which they are undergoing not only mental stress but also
financial hardships.
3. Now, the most of the officers have completed three years at their
places of work. After their DPC, at least 3 DPCs happened for the post of Assistant
Commissioner and we are thankful that the most of those officers have been considered
to be posted to the parent Zones. The 2020 batch of promoted Assistant
Commissioners are still working and struggling away from home. However, they
kept performing their duties with full dedication even during the times when
all zones were short of manpower at this level.
4. Further
many of these offices have applied earlier and now also for transfer on compassionate
grounds viz, working spouse, self-medical grounds etc. etc. However, their
applications were not considered at earlier occasion. Your kind
attention is also drawn to following:
(i) As per Para B
(2) (vii) of the Government of India O.M. No. 1669289899529 Dt. 24.11.2022
issued by DOPT, “in case of one spouse employed under Central Government &
the other spouse is employed under State Government then the Spouse employed
under the Central Govt. may apply to the competent authority and the competent
authority may post the said officer to the station or if there is no post in
that station to the State where the other spouse is posted”.
(ii) As per Para
–11.2 of CBIC Letter dated 12.04.2018, i.e., Transfer/Placement Guidelines, for
IRS (Customs & Central Excise) Officers, “In case of working couple, an
officer may be posted at the same station”.
(iii) As per Para 11.1. of CBIC Letter dated 12.04.2018, the
Placement Committee is empowered to take a decision in case an officer seeks a
posting to a particular station on medical grounds.
(iv) Ther also exist various provisions like posting
of the officer at desired place on account of deaf & dumb wards, wards studying
in Board classes, both spouses working under central govt. etc. etc.
5. It is once again submitted that it is really very difficult to be
away from the family at this stage. In view of above, it is requested to kindly
repatriate all of such willing Assistant Commissioners to their parent places
whether promoted in 2020 or later. It is also requested to kindly take into
consideration all compassionate grounds as submitted above including the spouse
cases, self-medical cases, medical cases of parents & family members, all
compassionate provisions relating to transfer and other compelling compassionate
grounds.
