year 2025.

It is mentioned in the above letter that, as per DOPT guidelines, it is
imperative that all DPCs upto the vacancy year 2025 be completed by the end of calendar
year 2024 except in cases where DPC could not be held on account of pending
litigation. The above letter has been sent to the cadre control authorities
working under the CBIC.

As far as the DPC for the post of Assistant Commissioner is concerned, the same
is to be conducted by the CBIC itself. In case of pending litigation, the DOPT
OM issued vide NO. 28036/8/87-ESTT. (D) Dt. 30.03.88 is very relevant. As per
the said OM, the DPC can be conducted for ad-hoc promotions in case of any
injunction by any Court/Tribunal or any seniority dispute. DPCs for the post of
Asstt. Commissioner were also conducted by the CBIC in the past based on this
OM.

As the Association understands, there exists no Court/Tribunal stay for the
post of Asstt. Commissioner on the DPC as on date and around 700 vacancies are
to be filled-in for the vacancy year 2024 itself. The vacancies for the year
2025 are also to be added in it.

In view of above, it is requested to take serious steps on immediate basis to
conduct the DPCs for the post of Asstt. Commissioner to update the same as per
the DOPT guidelines as our officers are forced to retire every month without
promotion for the want of DPC without any fault on their part despite of huge
number of the vacancies existed.
