Sub: Representation against Draft Seniority List of Assistant Commissioners of Customs & Indirect Taxes [Group 'A' of IRS (C&IT)] appointed/promoted against the vacancy year 2013-14, 2014-15 & 2015-16 - reg.

Kindly refer to the letter F. No. A-32012/85/2023-Ad.II Dt. 25.09.24 of the CBIC on the above subject addressed to the undersigned.

2. It is submitted with due regards that the disposal of the representation was expected in the form of a detailed and reasoned order taking into consideration every point made in the representation. On the contrary, a single line disposal was made informing that 2118 temporary posts of Asstt. Commissioner were created in 2013 by the Cabinet subject to the condition that this will not entail further promotion beyond JTS without considering all the facts submitted in the representation.

3. It is also brought to the kind notice of your goodself that the temporary employees working like regular Govt. employees can't be denied equal benefits as per the verdict Dt. 22.08.24 given by the Hon’ble Supreme Court in the CIVIL APPEAL of 2024 arising out of SLP (Civil) No. 30976 of 2017.

4. Accordingly, it is requested to kindly dispose off the representation by making a detailed and reasoned order considering every point made in it for the sake of justice in the light of the above mentioned verdict given by the Hon’ble Supreme Court.
