Sub: Discrimination in implementation
of court orders in the matter related to enhanced pay
scale of Inspectors and Superintendents w.e.f. 01.01.1996 instead of
21.04.2024.
Sir,
Kindly refer to the policy accepted & adopted by the
CBIC in
the matter related to enhancement of pay scale of Inspectors &
Superintendents notionally from 01.01.1996 and payment of arrears actually from
21.04.2024. Accordingly, the CBIC has accepted the various court orders on
the said matter and issued so many letters to the various CCAs for
implementation of the same resulting in the enhancement of pay/pension &
payment of arrears to the applicants in the court cases.
2. It
is further submitted with due regards that the CBIC has very recently accepted
the Order dated 17.12.2025 passed by the Hon’ble CAT, Allahabad Bench in the OA
No. 816 of 2025 partially to the extent of adopted policy and going to file
review/appeal on the limited disagreed portion. Accordingly, a letter F. No.
A-23011/05/2025-Ad.IIA dated 19.03.2026 has been issued for payment of arrears.
But, very unfortunately, the CBIC has not adopted the same approach towards the
applicants of the other orders including the following ones passed by the
Hon'ble CAT. The CBIC did not accepted these orders partially to the extent of
their adopted policy as done in the case of OA No. 816 of 2025-

3. In
this regard, your kind attention is invited to the letter F. No.
A-23011/05/2025-Ad.IIA dated 22.08.2025 and F. No. A-23011/05/2025-Ad.IIA
Dt. 22.01.2026 of the CBIC wherein the CBIC has issued
the directions to challenge the aforesaid first four orders before the Hon’ble
High Court and file review petition for 5th order. This
is highly discriminating to the applicants of the above court cases as they
have been treated differently and deprived from the benefit of policy adopted
by the CBIC whereas the applicants of OA No. 816 of 2025 have correctly been
given favorable treatment.
4. In
view of above, it is requested to kindly extend the benefit to all
the applicants and equally placed officers according to the adopted policy to undo
the discrimination in the same manner as given to the applicants of the OA No. 816 of 2025.
