Sub: Cadre Restructuring of CBIC.
Sir,
Kindly refer to the minutes of the Board meeting held on 08.04.21.
2. It
is to submit with due regards that it has been decided by the Board in the said
meeting that 10 additional posts of Deputy Secretary/Director and 30 additional
posts of Under Secretary would be created by diverting the posts of
Additional/Joint Commissioners and Deputy/Asstt. Commissioners. Needless to
submit further that the said diversion would adversely affect the promotional
avenues of the executive field officers who are already forced to retire after
single promotion barring a few after being recruited at the level of Inspector
due to the faulty human resource policy of our CBIC authorities.
3. It is further submitted that the creation of the
posts of Director, Deputy Secretary and Under Secretary can no way be the part
of the cadre restructuring of CBIC. Rather it is clearly the part of the cadre
restructuring of the Central Secretariate Service which is not in the hands of
our Board.
Instead of it, our Board should think how to improve the promotional avenues of
our own Group B executive officers who are already highly stagnated.
4. In the cadre restructuring of CBIC, the staffing requirements of our Directorates and field
formations can only be included. The posts of Director, Deputy
Secretary and Under Secretary, being belonged to the cadre of the Central
Secretariate Service, can’t be created in the cadre restructuring of the CBIC
and it will be totally unlawful. These posts no way belong to any cadre or service of
the CBIC. Therefore, these posts can’t be included in the
cadre restructuring of CBIC. CBIC can’t deviate the posts of Additional/Joint Commissioners and Deputy/Asstt.
Commissioners to create the additional posts of Deputy Secretary, Director and Under
Secretary.
5. It
is very painful that our own authorities are not serious about our career
prospects. The cadre restructuring proposal of the CBIC is yet to be sent to
the DOPT whereas it was to be sent to them upto the extended date of 28.02.19.
It is reiterated that the number of posts in the proposed separate service,
namely IRS Branch B, for our officers in the cadre restructuring proposal of
CBIC are required to be enhanced at each level in proportion of the cadre
strength of our officers. This can be done by optimizing the number of posts at
Commissioner level and abolishing the posts above the level of Commissioner as
there is no functional requirement of these posts under GST.
6. It is reiterated that the number of the posts in IRS Branch B have
been proposed neither in the desired number nor in the desired proportion. The malafide of
the CBIC is clear from the fact that they have proposed the post of Deputy
Commissioner more in number (677) than even the sanctioned strength of the
direct recruit Asstt. Commissioners (624) whereas only 350 posts of Deputy
Commissioner have been proposed for 3092 promotee Asstt. Commissioners. Not
only this, the malafide of the CBIC is also clear from the fact that they have
merged the posts at the level of Joint Commissioner and Additional Commissioner
to grant Non Functional Grade to direct recruit Asstt. Commissioners on Ist day
of 14th year calculated from the year following the year of
examination whereas they not only differentiated the posts at these levels for
promotee officers but also proposed meager number of posts to deprive the
promotee Asstt. Commissioners from promotions as well as Non Functional Grade.
Likewise, CBIC proposed only nine posts of Commissioner for 3092 promotee
Asstt. Commissioners whereas they proposed 497 posts of Commissioners and above
for 624 direct recruit Asstt. Commissioners instead of proposing the posts in
the proportion of the cadre strength of both categories
7. In view of the above, it is requested to
kindly-
(i)
Not
create the posts of Director,
Deputy Secretary and Under Secretary in the cadre restructuring of CBIC by
deviating the posts of Additional/Joint Commissioners and
Deputy/Asstt. Commissioners.
(ii)
Enhance the number of posts at each
level in due proportion in IRS Branch ‘B’.
(iii)
Keep the
ratio for promotions identical for direct Group ‘A’ service and Branch ‘B’
service. Number of promotional posts and feeder posts should be in the same
proportion at each level in both services.
(iv)
Not
bifurcate the number of the posts of Joint Commissioner and Addl. Commissioner
in IRS Branch ‘B’.
(v)
Promote
our
Inspector to the post of Addl. Commissioner on Ist January of seventeenth year
of service.
(vi)
Merge
three Group ‘B’ Executive streams with retrospective effect to bring the officers
of same year to same level of promotion.
(vii)
Abolish extra posts of Commissioner and all posts
above the level of Commissioner.
(viii) Shift
administration of CBIC to the hands of senior IAS officers for smooth, fair and
impartial functioning.
(ix)
Send the
cadre restructuring proposal to the DOPT at an early date for further action.
