            Kindly refer to letter  F.No.CoC/CPC/2016-17 Dt. 18.10.16 of COC representing Staff/Officer Associations under CBEC & CBDT on the above subject.
2. This is for your kind information that the resentment in the entire Group B, C and promotee Group A officers & the members of the staff side of the CBDT & CBEC had compelled the joint forum of the Co-ordinating Committee in the Department of Revenue to unanimously opined that the Department of Revenue is very much reluctant to attend the genuine grievances of its employees working in the field formations.
3. In the above context, it is requested to your goodself to redress  the following Charter of Demands-
 CHARTER OF DEMANDS

a)      To ensure Minimum five up-gradations to all officers in uniform Promotional Hierarchy across all departments/Ministries in Govt. of India.
b)      To settle the pay anomalies & cadre structure of Havilder & Head Havilder of CBEC with similar cadre of IB/CBI/Other Departments. Accordingly, Grade Pay of Havaldar should be Rs. 2400/- in place of Rs. 2000/-.
c)      To Settle the pay anomalies of Inspector (GP of Rs. 4800/- instead of Rs. 4600/-) & Income Tax Officer/Superintendent (GP of Rs. 5400/- in PB3 instead of Rs. 4800/-) of Revenue Department with the same Grades/Cadres of IB/CBI/Other Departments.
d)     To bring in an identical pay structure & promotional hierarchy of the administrative wing in CBDT & CBEC which should also be at par with Hqrs Organization, i.e., Central Secretariat Office as mentioned in 7th CPC recommendations.
e)      To maintain the pay parity between the Auditors/Accountants of the Audit & Accounts Department and the Tax Assistants in Revenue Department and UDCs of other Central Govt. Departments, which have all along been in the same pay structure.
f)       To finalize and/or modify the Recruitment Rules (including the ones, already notified viz., Executive Assistant & Tax Assistant under CBEC) after taking into account the suggestions/views of staff Federations/Associations, representing the Stakeholders, immediately.
g)      To Hold DPCs immediately to fill up all the vacant posts in various cadres.
h)      To fill up all the vacant posts in direct recruit quota by way of special recruitment drive.
i)        To restore the sanctioned strength of drivers prior to cadre restructuring and purchase of more Govt. Vehicles. Merger of the cadres with main stream cadres in the same Grade Pay after suitable relaxation may be an alternative option.
j)        Restoration and revision of Rummaging Allowance and Diet Allowance paid to Customs Superintendents and Inspectors (Preventive Officer) in CBEC.  
4. Your goodself is also requested to kindly direct the concerned to hold the Departmental Council Meeting of the Ministry of Finance, which has not been taking place for the last 11 years, and settle the demands in the amicable manner especially the anomalies which have arisen from the recommendations of the 7th CPC.
5. The following programmes will also be observed to project the above mentioned issues, if no redressal is made-
1) On 9th November, 2016, the employees and officers of the field formations of Revenue Department will hold Lunch Hour Demonstration all over the Country.
2) On 7th December, 2016, the employees and officers will wear Black Badges with pending demands to attract the attention of the authorities.
3) On 5th January, 2017, Day long relay Dharna programme will be observed.
4) If no settlement is reached, the Federations/Associations would be constrained to call upon its members for organisational action including cessation of work by taking mass casual leave in February, 2017, when the Hon’ble Finance Minister rises to present the annual budget in the Parliament.

            Kindly refer to our earlier submission dated 2nd May, 2016 on the above subject (copy enclosed).

This is for your kind information that the resentment in the entire Gr. B, C and promotee Gr. A officers & the members of the staff side of the CBDT & CBEC had compelled the joint forum of the Co-ordinating Committee in the Department of Revenue to convene a meeting on 24th September,2016 in Kolkata and unanimously opined that the Department of Revenue is very much reluctant to attend  the genuine grievances  of its  employees working in the field formations. Members present in the ibid meeting also raised their concern to the fact that the Departmental Council Meeting under JCM scheme has not been taking place since 2005 and the employees of the Department of Revenue had expressed their discontent and frustration for the absence of any proper grievance-redressal machinery for presenting the just demands of its officers/officials.

In this context, the said meeting has decided to request your goodself to redress  the following Charter of Demands.

  CHARTER OF DEMANDS

a)     To ensure Minimum five up-gradations to all officers in uniform Promotional Hierarchy across all departments/Ministries in Govt. of India.

DPC

Dear friends,
namaste.
Every effort is being made to get the DPC for the post of AC done keeping in view our regularly retiring officers. It was expected in the month of August/September but couldn't happen due to legal stay by Chennai CAT regarding the implementation of Parmar case. Every effort is being made to get this stay vacated without questioning the merits of the cause of the petitioners. It is, however, being learnt that the CBEC is going to issue some circular regarding the Parmar case.
          The DG, HRD has already communicated to Chennai zone to do the needful regarding this case for vacation of stay, so that the DPC may be conducted at its earliest. The information for 2014-15 and 2015-16 is already more or less available with the HRD to conduct the DPC. The CBEC was also requested to upload the list for 2016-17, for which a tentative list is already ready. But it seems that all vacancies for the years 2014-15 and 2015-16 will not be filled-up due to large number of retirement and accordingly, the remaining vacancies are to be carry forwarded to 2016-17 to extend the consideration zone. So, exact list for 2016-17 may only be published after the DPC of 2014-15 and 2015-16. Accordingly, the DPC for the year 2016-17 will be conducted within month of the DPC of 2014-15 and 2015-16.

2. Your kind attention is also invited to the letter F. No. CBEC-10C13(12)/1/2016-Ad.II B Dt. 29.09.16 mentioning that the recognition of this Association has lapsed on 20.01.15 and proposal for renewal is awaited.
3. It is worth to mention with due regards that no renewal of recognition is actually required for an already recognised association under current rules. Merely re-verification of membership is required, if administration wants it. This re-verification of membership is also not required in our case because there exists no other Association/claimant to represent the Central Excise Superintendents.  
4. It is also worth to submit that the recognition of the Association was renewed vide letter F. No. 12017/10/2012-Ad.IVA Dt. 25.02.13 of the CBEC further for 5 years w.e.f. 21.01.10 instead of 25.02.13, i.e., date of the issuance of the letter. It should have actually been renewed upto 25.02.18 vide above said renewal letter to count 5 years from the date of the issuance of this letter.
5. Despite of no renewal required, this Association sent the renewal proposal vide its communication under Ref. No. 218/R/14 Dt. 26.11.14 well in advance on insistence of the concerned section which was responded after more than one year by that section vide letter F.No.B. 12017/09/2015-AdIVA Dt. 11.12.15. Again despite of no requirement of renewal under the current rules, all queries were replied vide Ref. No. 156/R/15 Dt. 27.12.15 of the Association immediately after receiving the above said letter from the concerned section.
6. It is reiterated that there exists no other Association/claimant representing Central Excise Superintendents in the CBEC except this Association. This Association has been complying all the conditions and Govt. instructions set out in the CCS (RSA) Rules, 1993 and will keep to comply the same regularly. It is also worth to submit that the recognition of the Association has never been withdrawn due to any lapse in complying the conditions or due to any other reason.
7. In view of the above, it is requested to take the necessary action accordingly and the name of this Association may kindly be struck down from the list of the associations whose recognition has been lapsed as per the version of the concerned section. If any re-verification of membership is really required, it is requested that the same may kindly be asked from the field formations 'on line' keeping in view that the thrust of the present govt. is already on paperless work and salaries of the govt. employees are already being prepared as well as sent electronically direct to the accounts of the concerned individuals.

13.10.16 meet

The two main assurances were (1) That the Manpower has been matched with the formations (2) Four verticals through which manpower has been managed are (i) DG Taxpayer Services (ii) Anti Evasion expanded & to be called DGSTRA((iii) Regional NACEN's in every state( iv) DG, Dispute Resolution office. The paper on  complete organization structure is to be given to Associations immediately & all local units are requested to send their proposals through CC's after discussion with them for which the Member has authorized. AN advance copy can be sent to DGHRD directly. The fundamental flaw of adopting Revenue/ Assessee base as the template  instead of  Workload for  creation was pointed out to which there was no response. Kindly note that only tomorrow's program is deferred and the rest depends on further progress. The request for Minutes was turned down on the ground that the trade & state officials as the may use it to advance their cause. The majority were convinced. You will understand in due course of time.

Meet with Chairman

Went again to Board office today and a meeting was held in the chamber of the worthy Chairman discussing the following points-
i) Immediate DPC for the post of Asstt. Commissioner.
ii) Pay scale to Central Excise Superintendent at par with DSP of CBI.
iii) NFU to our officers to grant financial parity with the best placed counterparts of CSS etc
iv) Measures that no senior officer of Central Excise is forced to work under junior officer of Customs.
v) Non-functional time scale in PB3 to Central Excise Superintendents like other counterparts instead of PB2 after 4 years of service.
vi) Next promotion of Central Excise Superintendent to STS.
vii) Scheme to improve the career prospects of Central Excise Superintendents as our officers are retiring with single promotion in the service career of 35-40 years.
viii) Implementation of the CBEC circular issued vide F. No. A-26017/44/94-Ad II (A) Dt. 08.03.95 regarding arrears of pay.
ix) Retrospective implementation of pay scale of Central Excise Superintendents at par with NCB.
x) Implementation of para 7.15.24 of 6th CPC report in light of UO No. 6/37/98-IC Dt. 24.11.14 of Expenditure.
xi) Undoing of MACP irregularities.
xii) Posting and Transfer in the grade of Superintendent of Central Excise in Coimbatore Zone.
xiii) Vacation of stay at Chennai CAT in Parmar case implementation.
xiv) Association office bearers not to be transferred out of Hqrs office.
Meeting was Chaired by the Chairman. Member (P&V) and ADG (HRM) also participated in the meeting.
They promised to conduct the DPC very soon and also take appropriate action on other points. Chairman was also pleased to say that our career prospects/man power would no way be affected by implementation of GST. He added that Hon'ble Finance Minister is with us. A meeting has also been called on 13.10.16 at 4 p.m. inviting other constituent associations of steering committee.

The meeting started with welcoming of the delegates by comrade Anupam Neeraj.
Com Kousik Roy, Secretary AICEGEOA WB, briefed the house about the issues relating to the 7th CPC requires attention of the leadership. He hoped that this meeting would come out with concretesuggestion of representation and protest program. He wished that this opportunity of discussion together will be properly utilized. He requested delegates to introduce themselves.He also introduced the Minutes Committee consistingof Sri ALok Karak & Sri Samiran goswami  before the house.
      Com Anupam Neeraj, President, AICEIA, proposed the name of Com Saugata Chakraborty,All India Customs Ministerial Employee Federation, to preside over the meeting that was seconded by Com Kousik roy and Com Samir Kumar Acharjee.
In his introductory address the chair asked the house to prepare and concentrate on a concrete agenda keeping in mind the reducing sphere of job. He asked Com Anupam Neeraj to brief the house about the agenda of the meeting.
Com Anupam Neeraj pointed out the attitude of the Govt. of the day at Centre towards its own staff. He elaborated his view by way of example of not releasing the allowances proposed by 7th CPC, while the pay structure has already been implemented. This is mere an attempt by Govt. to accommodate the amount of total expenditure in account of 7th CPC within the amount allocated in the budget for the purpose. This is a lay level manipulation of ideal employer.
 He emphasized that the house should take suitable measures to establish for horizontal and vertical parities disturbed by 7th CPC.He also added that officers serving in Central Excise Part will be badly affected if the parity is not restored as there are chances of transferability of officers from Centre to States in GST regime.He urged the house to take a chalk out a clear cut program extended upto Jan’17 and use all means to convince the Govt.
Com Rupak Sarkar, Joint Convenor of the COC, Revenue briefed the house that no solution has been done after meeting held on 28/03/16.He pointed out the need to revise State Level Organization of COC before going into any program.He pointed out that no recommendation from the revenue department has reached implementation cell till date due to indifferent attitude of the Nodal Officer in part of Revenue Department. He urged the house that the resolution of the last meeting should be finalized with relevant modifications and a memorandum should be submitted to the department and the Board.
Com Ravi Malik, Joint Convener of the COC,Revenue submitted before the house that the issue related to Cadres having more than Rs 4200/- GP will not be covered under anomaly committee. He emphasized that the house should resolve for such programs which we can follow. The call of Indefinite Strike is the last and ultimate call. He proposed that Mass casual leave is an alternative to strike and the CL applications should be submitted to higher authority for pressurizing to fulfill our demands. We have to go to every office to motivate the cadres to do everything as united.
Com  Sayantan Bannerjee representing ITGOA stated that the steps should be taken consciously and not under the heat of the moment. He further said we have been given nothing by the govt. and in such a situation what is needed to be done should be deliberated upon. We have to start from grass rootlevel; Mass signature campaign should be arranged so that the cadre should be aware of the programs. We have to pressurize the Govt. because we have large no of cadre strength, being in revenue department the Govt. also depends on us for finance and economy. He also assured the house that on GST issue they will extend all support to the CBEC formations.
Com Asim pramanik of AICESTOMA put before the house that the memorandum, which has been submitted earlier, need to be modified. He asked the house to discuss the ways to pursue our demands. He proposed for continue dialogue with a trust on Govt. before going into any aggressive action. He submitted before the house that the Govt. needs our support at this crucial time. He affirmed the proposal of mass signature campaign and then mass casual leave. He requested the house for suitable modification in the charter of demand. He urged the house that instead of chalking out long range of programs the house should go for brief programs which can be suitably reviewed after sometime.
Com Ashish Chakraborty of AICGCOA , expressed his concerns before the house that the office side has not given any response to the earlier memorandum submitted by COC.He agreed to the view that the general members should be convinced first before taking any action further but the leadership should chalk out the proposed programs here and then the work of convincing general members will be meaningful. He requested all federations to mobilize their cadres for a set of programs before Jan’17.He expressed the need of mass campaign at major metros and in Delhi before Budget.
Com Anupam Neeraj,Joint Convener of the COC,Revenuepointed out the concerns of general members about the seriousness of COC.He put a question to the house as to how long we shall pursue our demands by writing memorandums only. He suggested on behalf of his organization that the house should decide in this meeting itself for 3-4 follow up actions which should spread over next four months and the same can always be reviewed if there is some positive gestures.If wereally want to pressurize Govt., only token programs will not entail any results and some stern actions must get place in the program. He opined that on this particular issue entire cadre is affected and the doubt of the leadership about convincing general members is not proper. He emphasized that rather than concentrating on our weakness we have to depend more on our strength. He asked the house to decide for united campaign programs across the country and creation of social media platform for better coordination.
Com I.B. Mishra, Secretary General, AICPSF affirmed the view that the required modifications in the earlier memorandum may be done. He directly took on the subject on pursuing the demands. He counted from his past experiences that peaceful measures never worked and urged the house that we have to bank on agitational programs if we want to really pursue the issues. Healso emphasized the need of taking concrete decision on future programsin this meeting only. He advised that the COC must seek appointment from the Revenue secretary to appraise him about our demands.
Com Saugata Chakraborty, Secretary General, All India Customs Ministerial Employee Federation placed before the house that the Budget Day and the Last Day of the financial year being the crucial days, these days are very important for observing any program. He suggested to chalkout program upto 31.03.2017 exhausting all options.
Com. Asim Pramanik stressed the need of parity in structure and pay of ministerial cadre of CBEC & CBDT. He opined that this is the ripe time for agitational program. He also proposed that the CoC should meet atleast once in three months.
Com Ravi Malik, suggested that the use of words should be tactical and instead of Lunch Hour Demonstration it can be Lunch Hour Peaceful Sitting, which has no mention in CCS conduct Rules. He expressed that to settle the demands of parity, we must ask for standard uniform promotional hierarchy across the department. He also opined that minimum five upgradations (functional/ non-functional) should be pressed on.
Com R. Chandramouly, President, AICEGEOA, stressed on taking strong and visible program. He also clarified before the house that for conduct rules the act we do is relevant not the name which we propose. He also elaborated that even the call of strike has got different judicial pronouncements depending on the case.
Com I.B. Mishra suggested that the date of mass casual leave should be such that the Government will feel the absence of the employee most.
Com Barun Roy of Customs Ministerial Officers’ Federation submitted that uniform decision should be taken for mass casual leave, he affirmed the cadre specific views expressed by Sri Asim Pramanik.
Based on the above discussion Sri Rupak Sarkar, Joint Convener, placed before the house the proposal of schedule as below :-
1.      Every office should be reached in the month of October 2016 for campaigning and to revive State CoCs.
2.      Lunch Hour Demonstration in every office on 09.11.2016.
3.      Black Badge wearing on 7th December 2016.
4.      Dharna program in front of CCA office/C R Buildings on 5thJanuary 2017.
5.      Mass Casual Leave on the Budget Day.
He also proposed that for proper attention one press conference can be done in Delhi after the observance of the program of 9th November. He also urged that for proper adherence to the schedule the memorandum must be submitted within 06.10.2016 clearly mentioning the schedules of agitation.

Com. Anupam Neeraj requested the house that the memorandum should highlight the fact that in pay matters the officers of Revenue Department have always been demoralised and Government has always disturbed the parity by putting Revenue officers at lower scales. Even the 7th CPC has disturbed the parity of Inspectors on wrong premises and parity of Superintendent/ ITO with Postal Superintendent.

Com Asim Pramanik briefed the house about the resentment in the ministerial cadre over the Recruitment Rules of Executive Assistants.

In view of the discussions held, the house took following resolutions :-
1.      State wings of CoC should be formed within 31.10.2016.
2.      A campaign Committee should be formed by the three joint Conveners.
3.      A notice addressed to the Finance Minister, copy to all concerned authority be submitted by CoC by 06.10.2016.
4.      By 21.10.2016 all the Associations/ Federations will serve the notice to the concerned authorities on the same lines as those in the notice by the COC. The format of the notice by the constituent associations to be decided by the COC for the sake of uniformity (not required).
5.      On 9th November 2016 in all offices Lunch Hour Demonstration will be held and memorandum including programme of agitation will be served to all CCAs.
6.      On 7th December 2016 Black Badge wearing in all offices will be observed.
7.      On 5th January 2017 day long dharna program in front of at CCAs office/ C R Buildings. (places decided by the local body will be held and after that uniform resolution of solidarity with the program will be submitted to the authority.Format of resolution to be provided by the central COC) not required.
8.      All members of CoC will observe Mass Casual Leave on Budget Day.
9.      The charter of demands will be modified in consultation with the Ministerial Associations.
10.  One CoC meeting will be convened in the month of December 2016 after 7th December 2016 to review the situation.
The House Finalised followingCharter of Demands :-
A.      Settle the pay anomalies between the cadres of Revenue Department with ( replace with by and) the cadres of IB/CBI/Other Departments.
B.      Minimum five upgradations in uniform Promotional Hierarchy for all the cadres across all department/ministries in govt. of india.
C.      Relaxation of RRs in various cadres for filling up of vacant promotional posts.
D.     Hold immediate DPCs to fill up the vacant posts in various cadres.
E.      An identical pay structure & promotional hierarchy of the administrative wing in CBDT & CBEC which should also be at par with Hdqrs. Organization i.e. Secretariat Office as mentioned in 7th CPC recommendations.
F.       To finalize/ modify the Recruitment Rules as per suggestions of Recognized Federations/Associations immediately.
G.     Restoration of sanctioned strength of drivers prior to cadre restructuring and more purchase of Govt. Vehicles/merger of staff car drivers with main stream cadres for shortage of staff cars.
H.     Filling of vacant posts in direct recruit quota by way of recruitment drive..
