2. Non-functional financial
upgradation (NFU) has already been brought for Group A officers vide DOPT OM
No. AB.14017/64/2008-Estt.(RR) Dt. 24.04.09 to grant them financial parity with
their counterparts of IAS, the best placed Group A cadre. So, no need to say
that bringing of NFU to grant financial parity to Group B officers with the
best placed counterpart is also urgent need of time. CCA and duties &
responsibilities are also different for Group A cadres but they have been
granted NFU. Association has not compared Superintendent with CSS but asked for
grant of NFU to bring financial parity with the best placed counterpart. Even
otherwise, the Superintendents have been conferred with higher duties &
responsibilities in comparison to any other counterpart including CSS. No need
also to say that the CBIC has already recommended the grant of NFU for
Superintendents at least on four occasions.
3. There are so many precedents of
Group B gazetted officers being promoted directly to STS. There also exists
precedent of promotion from GP of 6600/- to GP of 8700/- in CPWD. The promotion
of Superintendent to STS as well as uniform promotional hierarchy across all
departments/ministries has also already been recommended by CBIC which is
urgent need of time as MACPS has been proved to be lossfull for our officers. As
far as the question of the residency period is concerned, the same may be
prescribed as per the DOPT OM No. AB-14017/61/2008-Estt.(RR) dt. 24.03.09.
4. Time limit for implementation of
verdict given in OA No. 2323/2012 by the CAT has already expired which
certainly invites contempt. The RRs are required to be reframed immediately prescribing
the qualifying services in consonance of the DOPT OM No.
AB-14017/61/2008-Estt.(RR) dt. 24.03.09 and having provision of automatic
upgradation to higher grade on completion of one and half times of residency
period as per the prayer of the Association.
5. You are silent in your reply on
the issues like Time bound promotions/scales, Notional promotions, Creation of
supernumerary posts, Creation of separate service, Direct promotion to higher
posts, In-situ promotions, Batch to batch functional upgradation and Introduction
of Flexible Complementary Promotion Scheme (FCS) or Dynamic Assured Career
Progression Scheme (DACP).
6. The needful may kindly be done taking due
consideration of the representations of the Association already made.

2. It is to submit with due regards
that the Pay Commission is merely a recommending body. It is not necessary that
the govt. employees can not be placed in the enhanced scales without the
recommendations of the Pay Commission. The most burning example is of the DSP
of CBI, the counterparts of the Superintendents, who were placed in the higher
scale equivalent to group A retrospectively w.e.f. 01.01.86 vide the order of
1996 without any recommendation of the Pay Commission or any other expert body.
3. Accordingly, the needful may
kindly be done in r/o DOPT OM issued vide Dy.No. 1173974/16/JS(CPC) in the month of
June, 2016
taking the due consideration of the representation of the Association. No need
to say that the action on the part of the concerned section of CBIC is still
pending on the said
OM even after the expiry of two years.
