Sub: Inter-Commissionerate Transfers.
Sir,
As you are aware, it is to submit
with due regards that the Inter-Commissionerate transfers of the Inspectors
were stopped due to seniority disputes. Many officers approached the legal
courts to claim their seniority of parent Commissionerate after transfer to the
other Commissionerate.
2. As
far as the Superintendents are concerned, no inter-Commissionerate transfer
was/is allowed to them. They were/are, however, allowed to go to other
Commissionerate on deputation basis. However, once Sh. Kundu was transferred to
Kolkata Commissionerate from Delhi and Sh. Sarkar from Kolkata to Delhi on
inter-Commissionerate basis on the ground that Superintendent cadre is having
All India seniority and the seniority is not affected on such transfer.
3. In the
present scenario, many of our officers belonging to Superintendent cadre want
to be transferred to other Commissionerate under the prevailing
circumstances. Seniority being counted on All India basis, it is reiterated
that their seniority would not be affected on such transfer and there would
also be no seniority dispute on this count.
4. It is also worth to submit that a proposal for separate service
for our officers has already been approved by the CBIC as proposed in the
ensuing cadre restructuring. As a result, all of three categories of Inspectors,
i.e., Inspector of CGST/Central Excise, Preventive Officer and Examiner, are
also to be merged into single cadre. Thus, various cadre control authorities of
CGST/Central Excise and Customs are also to be merged into single with All
India seniority to be maintained at Inspector level also. So, inter-Commissionerate
transfers may be opened for Inspectors also by deciding a date for merger.
5. In view of the above, it is requested,
(i) To start inter-Commissionerate transfer for our
Superintendents as their seniority, being already on All India basis, will not
be affected by it.
(ii) To restart inter-Commissionerate transfer for our
Inspectors keeping in view that a separate service as well as merger of cadres
has already been proposed for them.
