Dear friends, namaste. A question may arise in the minds of the member officers why appeals/requests are made for providing funds to the Association. Friends, only Rs. 60/- per year per member is subscribed to the All India Body by the Association Units. No need to say that it is a meager subscription amounting merely to Rs. 5/- per month per member. Under such circumstances, the All India body of Association is forced to make repeated appeals to members in the common interests of cadre. We have fought/are fighting various legal cases in the legal courts in the common interest of the cadre. No need to say that we have to hire Senior Advocates for each and every case who charge hefty fees per hearing alongwith the fees and expenses of the regular advocate. In addition to legal expenses, Association also requires funds for administrative, organisational and various incidental expenses. NOW, WE ALL HAVE TO DECIDE WHAT TO DO!!!!!!!!!!!!!!!!             Kindly refer to the Office Order No. 02/Ad.IV/2018 issued vide No. A-11013/10/2016-Ad.IV Dt. 12.02.18.

          2. With due regards, it is to submit that the various group ‘B’ and ‘C’ cadres including executive cadres of all Directorates under CBEC/CBIC have been merged into one common cadre with common RRs vide above referred order. 

3. Your kind attention is also invited to the various representations of the Association since very beginning for the merger and unification of group ‘B’ executive cadres of field formations under CBEC keeping in view the wide disparities in promotions from zone to zone. No need to say that the issue of promotional disparities has also been accepted by the CBEC/CBIC on various occasions but no corrective measures have been taken till date.

4. Due to the regional disparities, the senior officers are forced to work under their juniors of Central Excise/CGST as well as Customs. As far as RRs are concerned, the RRs are already common for the Inspectors as well as Superintendents of the field formations. The All India Seniority List is also common for the Superintendents.

5. Not only it, the Customs cadre has been made separate further bifurcating into two without any justifiable reason at group ‘B’ non-gazetted as well as gazetted level. Due to this unreasoned trifurcation of single cadre at non-gazetted as well as gazetted group ‘B’ level, the Central Excise/CGST executive officers are forced to work under their extreme juniors of Customs. It is also worth to mention that there exists no separation or trifurcation of cadre at group ‘A’ level. This all results into intra-cadre as well as inter-cadre disparities in promotions.  

6. In view of the above, it is again requested to kindly take necessary steps also to merge the executive cadres of field formations under CBEC/CBIC and also unify the cadres of Customs & Central Excise/CGST at non-gazetted and gazetted group ‘B’ executive levels to bring all the officers of same batch at par in the matter of promotion.

Policy for Removal of Non-Performing Civil Servants

The provisions under Fundamental Rules (FR) 56(j), Rule 48 of Central Civil Services (CCS) (Pension) Rule, 1972 and Rule, 16(3) (Amended) of All India Services (Death-cum-Retirement Benefits) [AIS (DCRB)] Rules, 1958 have laid down the policy of periodic review and premature retirement of non-performing Government servants.

Up to January, 2018, a total of 21,195 Group ‘A’ and 47,039 Group ‘B’ officers have been reviewed, out of which provisions of FR 56(j) and relevant rules were invoked/recommended against 83 Group ‘A’ and 128 Group ‘B’ officers, including 15 officers of All India Services.

This was stated by the Union Minister of State (Independent Charge) of the Ministry of Development of North Eastern Region (DoNER), MoS PMO, Personnel, Public Grievances & Pensions, Atomic Energy and Space, Dr. Jitendra Singh, in written reply to a question in the Rajya Sabha today.

            Kindly refer to the Ref. No. 113/AIB/G/17 Dt. 28.09.17, 120/AIB/G/17 Dt. 11.10.17, 121/AIB/G/17 Dt. 11.10.17, Ref. No. 171/AIB/G/17 Dt. 13.12.17 etc. of the Association.

          2. With due regards, it is to submit that the SLP(C) No. 029382/2011 filed by the CBEC in the Subramanium case has been dismissed on 10.10.17 by the Supreme Court. Thus, now there remains no other option except to implement it giving the benefit to all equally placed officers. The issue involved in this case is the grant of time scale on completion of 4 years of service after getting ACP/MACP upgradation to our officers after joining as Inspector, whether direct recruit or promotee. 

3. Your kind attention is also invited to the counter-reply of the CBEC in the case filed by the Association for the general implementation of the Subramanium issue to give its benefit to all equally placed officers. In the said counter-reply, the CBEC has mentioned that the reason of not implementing the issue in general for all is the pendency of the case in the Apex Court.

4. But now after the dismissal of the SLP of the CBEC and finalization of the case at the level of the Apex Court, there remains no reason coming in the way of the general implementation of this case.

5. In view of the above, it is again requested to kindly take necessary steps to implement the said court verdict in general for all equally placed officers at an early date.

Appeal not to stall the DPC

Dear friends,
namaste.
            No need to say that everybody has legal right to fight for one's cause. But as far as the promotions for the post of Asstt. Commissioner are to be affected, it is to be done merely on ad-hoc basis which may be reviewed any time on finalisation of the concerned issue. No need also to repeat that our officers are forced to retire every month without getting the rarest IInd promotion for the want of DPC. Stalled DPC to the post of Asstt. Commissioner is not only forcing our Superintendents to retire without promotion but it is also adversely affecting the promotions of equal number of officers at Inspector, Ministerial and even lower levels due to cascading effect.
           Everybody of us know that the temporary posts of Asstt. Commissioner would lapse in the month of coming December. Once lapsed, everybody will lose the chance to get promoted. So, it is again appealed kindly not to stall the DPC irrespective of making legal fight on any issue. If the final verdict goes in the favour of the petitioner/s, no need to say that he/she would certainly get his/her share.

DPC

Dear friends,
namaste.
            I am getting regular calls about the DPC for the post of Asstt. Commissioner. It was expected to be held at any time in the month of March-April but couldn't happen in March due to some legal stay. The matter is being pursued very vigorously for its administrative as well as legal resolution. The CBEC has already filed a SLP and also an IA in the Supreme Court for early DPC subject to the final verdict in SLP. An IA has also been filed by the Association for an early DPC subject to the final verdict of SLP.
           Now, matter has been posted for 11.04.18 by Supreme Court. Unfortunately, some petition has also been filed By Sh. Manimohan opposing the issue of early DPC. He has sought the implementation of Parmar case before conduction of the DPC. No need to say that the issues relating to seniority including Parmar or any other case/s should be resolved at the earliest in the manner that no injustice is done to any body/category but it would certainly take time being a lengthy process first requiring review DPCs at local levels by all CCAs of Customs as well as Excise/GST including all cadres upto the level of Superintendent and then recasting of All India Seniority List. So, the best way is the holding of DPC subject to the final verdict/implementation because of the promotions being affected merely on ad hoc basis and our officers being retired without promotion on monthly basis.
           Now, after opposition by Sh. Manimohan and associates, it is apprehended that the case may be lingered on further delaying the DPC; however, the Supreme Court has placed it for 11.04.18 for finalisation. If finalised, we don't know what the final fate would be. Before filing the objection by Sh. Manimohan and associates; it was, however, expected that Supreme Court would be pleased to grant the due permission for the DPC. It seems now that we would require to hire a good senior advocate for early DPC subject to the final verdict/implementation in the matter. No need to say that it would require hefty funds, the best way for which is the immediate collection of legal funds for this case by we all and particularly by those officers whose names already figure in the consideration zone. Contribution in thousands will enable us to collect funds in lacs to hire a good senior advocate. The details of the account of the Association are as under-

Sub: Benchmark for MACP upgradation.

            Kindly refer to the Ref. No. 03/AIB/B/17 Dt. 03.01.18 and 83/AIB/G/18 Dt. 30.03.18 of the Association.

            2. Your kind attention is also invited to the Circular No. 107/E-9/Estt.-I/DHC Dt 27.01.18 of the Hon’ble High Court of Delhi (enclosed herewith) implementing ‘Very Good’ benchmark w.e.f. 01.01.18.

3. With due regards, it is to submit again that the benchmark for MACP upgradation has been prescribed to be “very good” for all posts w.e.f. 25.07.16 vide DOPT OM No. 35034/3/2015-Estt(D) Dt. 28.09.16.

4. The clarification given to CBEC by the DOPT on the issue says that the officers having post 2009 ACRs/APARs with at least “very good” grading now would only be eligible to get MACP upgradation.

5. No need to say that new condition would make it difficult for employees to avail MACP upgradation because the change of benchmark from ‘Good’ to ‘Very Good’ should only have prospective effect as many employees may find it impossible to meet the benchmark based on the said change.

6. Thus, the grant of MACP upgradation on the basis of the reports of earlier years when the said stipulation of ‘Very Good’ was not in existence must be calibrated on the basis of the earlier stipulation of the benchmark being `Good’.

7. In the clarification given to the CBEC by the DOPT, it has also been mentioned that there is no question of allowing IInd opportunity of representation against the APAR which are post-2009 as these are already disclosed to the employees. Regarding this, it is to submit that the benchmark was ‘good’ at the time of said disclosure. The benchmark has been changed to ‘very good’ vide the DOPT OM No. 35034/3/2015-Estt(D) Dt. 28.09.16 only. Accordingly, this provision needs to be reviewed.

8. In view of the above, it is requested to review the DOPT OM No. 35034/3/2015-Estt(D) Dt. 28.09.16 and implement the ‘Very Good’ benchmark w.e.f. 01.01.18 only as done in the Hon’ble High Court of Delhi.
